      You have to be aware that there is no actual time limit on how long it will take for Newlyns to give up. bailiffs can be very tenacious, mainly because if the debt gets returned to the Council then they won't be paid.

      Just be strong and stand up to them, once they realise that you know your rights and aren't going to be bullied they will crawl back under their stone. You do not have to let them into your house, or even speak to them.

          You are panicking about something that might not even happen. Quite often when bailiffs realise you know what you're doing and that they cannot muck you around - they will back off.

          Are you saying you have asked Newlyn how much you owe them for the letters they have written to you? If so, they are not allowed to charge you anything by law for sending letters concerning council tax debt.

          Even if they are on your doorstep when you arrive home, you do not have to let them in, but as I have already said - it might not even happen.

            thanks i know im panicking im trying to be calm now no when they send me 4 letters with all different amounts of what i owe i have wriiten to the council to ask them exactly how much i owe i put that in the letter that i told them im paying them the debt not newlyn and i have paid newlyn 100 pounds

              It does seem really scary when they are contstantly threatening you and increasing their fees - I had loads of sleepless nights. Just be aware that they cannot charge you and cannot come into your flat unless you let them in. They are not allowed to harrass you in the street or discuss your case with any neighbours. If you can pay the council online it is the best way. Newlyn may not stop coming round for a while but they will eventually give up as it is better for them to chase someone who is going to pay.

              Keep all your door and windows shut and don't repond to them at all. Even while you are waiting for the council to respond keep paying them directly. if possible. The council may tell you that you have to pay the bailiffs but this is not true.

                  A couple more snippets which may help you.

                  By not including details of the charges imposed on their letters, the Bailiffs are not acting in accordance with the National Standards for Enforcement Agents (no surprises there)

                  Quote -
                  Enforcement agents will on each and every occasion when a visit is made to a debtor's property which incurs a fee for the debtor, leave a notice detailing the fees charged to date, including the one for that visit, and the fees which will be incurred if further action becomes necessary. If a written request is made an itemised account of fees will be provided.

                  In addition, as a single parent you should advise them you a vulnerable person as defined by the National Standards for Enforcement Agents, and their visits are causing a great deal of upset and distress.

                  Have you checked the council tax bill is correct? Are you getting your 25% single person discount? Are you in receipt of benefits or on low pay? You may be entitled to Council Tax Benefit to reduce your Bill.

                  If you do not give the Bailiffs access to your property, they cannot take anything, their only option is to return the liability order back to the council. When it is returned, you can request an attachment of earnings order, the amount of each instalment is calculated in accordance with regulations as opposed to whatever amount the Bailiff can bully or frighten you into agreeing.

                  In your written communication with the Bailiffs and/or the council, it is worth (repeatedly) including a sentence to the effect that
                  ‘you are not refusing or attempting to avoid any liability or payments and you are willing to make payments by installment at a rate you can afford’,
                  this will deter the council from making a wasted application for committal to prison, which a court will only grant is you are refusing to pay.

                    thanks judge mental im not sure how much i owe the council in the letter i wrote to them i asked for them to send me howmuch i owe in the letters the ballifs have sent me all different amounts i do get the 25% discount i have sent in a application for housing benefit and council tax benefit the letter i sent to to ialington council i said dispute the amount owed as that i paid newlyn 100 pounds and have asked newlyn to forward the 100 pound to them and as from monday 11 oct i will be paying them 50 pounds per week untill the debt is cleared and i also gave the ref number so it is taken off the debt
                    i wrote to newlyns telling them i am fully aware of my rights and they will not gain access to my home under any circumstances to levy goods i told them as from monday 11 oct i will paying islington council and ive asked them to send me a itemised statement to see what charges have been added ive sent islington council a copy of the letter i just hope this works im going to keep up the payments

                      Your application for Housing/Council Tax benefit should be dealt with within 14 days, you should receive an amended Bill (subject to your entitlement of Benefit) and may well find you dont owe anything, or even better, they owe you!!

                      I know its easy to say, but dont worry too much about the Bailiffs, despite what they might imply you are under no obligation to deal with them in any way, providing you do not give them peacable entry to your property, there is absolutely nothing they can do.

                      When you get a response from them regarding their fees you can then check if they have been applied correctly and if not, show them the same lack of respect, consideration and non-negotiable attitude as they have given you . . . it does make you feel much better.

                          just an update i still have not had any replys to my letters send to islington council or newlyn i have been paying debt to islington council and they have been receiving my payments and taking it off the debt.
                          Yesterday morning had my first visit from the ballifs with the van i never answered the door they rang the door bell once put a note through the door asking me to contact the ballif or he will be abck to remove goods from my property i know e cannot do this

                            Good. So write to your council, enclosing a copy of what the bailiffs left you and ask what they propose to do about this and also what they propose to do to ensure that it does not happen again to other debtors.

                              Amy, I know they will have a record of it, but is it worth blondgal stating to the council they have quite happilly been taking her payments - doesn't this amount to them taking the debt back from the bailiffs?

                                Yes it does, but this is not the issue and is not what I was referring to.

                                The issue is the bailiffs threatening to return and remove goods which they cannot do since they have not been allowed peaceful entry.
