Don't know which route to take! I spoke to ICO today, they tell me they have 3-4 month backlog of complaints, so don't expect a quick response. I'm sure I saw a post on here by Bailiffchaser, saying you need the backing of the ICO before going down court route.

The warrants for these PCN's were issued 2/3/10 & 8/3/10, by the time the SAR is enforced would the warrants be expired?

If I take the court route, how do I go about that and how costly would it be?

I am confused. I thought the SAR was sent to Bristow & Suitor, but now see Philips are mentioned frequently.

Are there two issues here a) an outstanding part payment to Philips together with an overdue SAR? and b) an overpayment to Bristor & Suitor and another overdue SAR?

You do not have to take the ICO route prior to issuing a claim for non-compliance, it is your decision which one you take.

Possibly, if they do not get their finger out, but the warrant is valid for 12 months.

If I take the court route, how do I go about that and how costly would it be?

You file an N1 with the court and the fee for this is, I believe, around £30.

Yes there were 2 separate Bailiff problems.

One was Bristow & Sutor for a B'ham City Council PCN, eventually got reply to SAR, but still waiting for response from Council to my complaint about whole matter.

The current issue is with Philips for 2 Westminster Council PCN's. Philips are claiming not to have received SAR letters.

I think I'll send off ICO complaint form as its ready to go. I spoke to Sheila Harding this evening and she said she will contact Westminster Council, as she thinks I've been speaking to Sertec (?) who act of behalf the Council. Depending on the outcome, I'll decide over weekend about getting the N1 form.

Will let you know what happens x

Since the 1st October the ICO are monitoring various organisations for 3 months for non compliance, these include Westminster City Council and Birmingham City Council among others. Checkout the following link:

Hi, just a quick question:-

2 PCN's totalling £336.32 of which I've paid £240 to Philips, leaving outstanding balance of £96.32. Both warrants of distress expire in 1 month. Accounts on hold due to disputed charges.

What happens if warrants expire before dispute resolved. Would you advise to wait for warrants to expire or pay outstanding balance direct to City of Westminster? (I won't pay Philips as they always 'lose' my payments)

Its been awhile since last posting, so just wanted to update you on the outcome.

Finally got reply to SAR on the 10th December 2010, but it was incomplete and missing information I had requested. Sent a letter of complaint to Ewan Cruickshank at Philips and a Formal Stage 1 complaint to Parking Services. To this day never heard another word from Philips. Parking Services replied backing up Philips and demanding £1040.32 to be paid. I complained again pointing out they had not addressed any of my issues.

31st January 2011 Parking Services replied still not giving straight answers but now reducing the amount to £570.32. I was so angry I picked up the phone and rang Damon Budds, Supplier Relationship Officer; Parking, Highways & Roads, Westminster City Council. I ranted at him about everything and to be fair he was very nice and said he would investigate my case and get back to me. I wrote to him briefly detailing my problems and enclosed a cheque for £96.32 in full & final settlement.

In the meantime I wrote again to the ICO updating them on situation, they asked for copy of SAR and my response to Philips. They replied that they were looking into the case and would let me know outcome. To date not heard anything.

6th April 2011 Damon replied saying the 2 warrants had been returned to the Council as they had expired (issued 4th & 10th March 2010). The amounts outstanding & bailiff fees were written off and my cheque for £96.32 returned. He said that they had discussed with Philips their contractual obligations and they will continue to monitor them. YIPHEE!!!! I won.

Many thanks to Amy and everyone on this site who has advised me and given me the confidence to fight for my rights. This site has been an education and by reading through the different areas I continue to learn more xx

If anyone is having problems with Westminster PCN's, Parking Services (Vertex) or Philips and have exhausted the regular lines of complaint, maybe they should get in touch with Damon Budds so that he is aware of what we are experiencing. I got the impression that Parking Services are probably shielding him from the truth of what goes on, getting rid of complaints as quickly as they can. His direct line is 0207-641-7995. Address:-
