    I have a son who owes 480 pounds for council tax it is a previous yr it was recalled by the council and he got an agreement to pay 10 a week however he became unemployed and over time he has not been able to keep up the payments and they av past it bac to bristow and sutor this had a wpo on it from a long time ago if tbey come can they still use that to come in and take goods he gets 60 a week and his wife who is pregnant gets sick pay from her work what can we do thankyou

    If the arrangement was with the bailiff then the WPO would still be valid, I'm not sure of the position after the debts been recalled from the Bailiff by the council, but I will ask someone to answer you who knows more.

    Was the WPO signed by the person named on the Liability order (your son I assume?)

    How long ago was this and how long has he kept up the payment arrangement for ?

    Have they looked into Council Tax Benefit ? Is his wife on statutory sick pay or full sick pay from work or stat maternity pay ?

    Have they been back in touch with the council since their position worsened ?

      he last made a payment at the end of aug the council are aware of his situation he is awaiting confimation of housing and council tax benefit doc av been took to the council in person but they carnt find them so he as had to make a fresh claim he was in court this week for this yrs c tax but the council sed they will help him sort that one out as it shouldnt av gone to court its the old one that is causing the concern dont think the bailiffs are going to let him pay it by installments he just cannot afford to pay it in one go it was his wife who signed the wpo the bailiff sed it was on lees behalf as he wasnt there can he ask for deductions to be made from his benefit i think she is on maternty pay now but she only worked 16 hours a week thankyou

        If the debt has been passed back to the council then the levy and associated walking possession are no longer valid, having been abandoned by the bailiff when they passed the debt back to the council.

        Who actually signed the Walking Possession Order, as it must be signed by the person named on the Liability Order and is not valid unless this has been done?
