        Amy the advice I am recieving from you and everyone is invaluable and I suppose I am panicking somewhat over my wife's car and the situation it has left us in.I would much rather move my car as it is for use with a small business I have just started although it is at present SORN it only requires the tax to bring it on the road,what do you think, should i move it??If i move it should i inform Marstons?

          documents faxed and mailed to Marstons should i move my car as i would like to keep hold of it and its only worth a few hundred pounds at most.What could/would Marstons do??

            Good. If you move it, as far as I know, there isnt much they can do other than go back to court for another order, possibly adding further costs, but it should buy you time to sort out the payments with the CSA.

              I have spoken with the CSA and they cannot speak about the case as its with Marstons I need to try and get this returned to the CSA so I can negotiate with them further(not that it got me anywhere before!!)
              Should I write to Marstons requesting they return it enclosing income & expenditure,no assets,low income etc etc

                She's not the debtor so the bailiff cannot touch your wife's car.

                Well there you go then, National Debtline should know full well that a bailiff is unable to levy/remove a vehicle if "You are self employed and the car is necessary in the course of your employment or business." However, you will need to tax the car to be able to leave it on the road.

                  Hi Amy

                  Thanks and I do trust you guys God knows where I would be without you all.

                  Regarding the old car it is used for my business a small amount of time(even though it is still not taxed-still saving up) so

                  Would that make a difference to marstons levy on it?

                  I plan to write/fax again to marstons explaining its for my business and that I have a right to move it and will be doing so.So they are aware there is no point in sending large truck to remove it and charging me the earth to do so is this a good idea??Naturally I wasn't going to tell them where i moved it to just that it is no longer here I owe enough without them adding on more and more.

                  I also plan to write to them asking them to return case to the CSA due to lack of income,assets and the fact they will not be allowed entry( I think they call it a Nul Buna Certificate??).I know its a bit of a long shot and that they can keep it for 13 weeks I believe but when they realise my predicament they may think it is just not worth it Should I include a income/expenditure to them???

                  You are all stars to me helping me to keep my sanity and will always be very grateful

                    As I said previously, you will need to tax the car if you are going to leave it "hidden" on a public road. In any case,you will need it to be taxed in order for you to drive it on the public roads while moving it to its hiding place.

                    You are making it too easy for them. Just write to them telling them that one car is your wife's and the other is yours but that you use it for business.

                    It's worth a shot (and it's a Nulla Bona certificate, where contact cannot be made or there are insufficient goods to levy distress on).

                    No, it's none of their damn business. Provide one to the CSA by all means, but I wouldn't be sending one to a bailiff.

                      Hi Ame

                      Just an update really have informed Marstons of the fact one car is my wifes(they have recieved the faxed V5) and that the other is used for my business and has actually been moved.Have also spoken to CSA and they are attempting to get the case returned from Marstons whatever it means it means things are hopefully moving in the correct direction.
                      Have heard nothing from Marstons since!!!

                          RESULT!!!

                          Marstons have already given up and returned the case to the CSA who now hopefully will negotiate a reasonable repayment plan.
