    Equita are proving to be a completely different kettle of fish entirely which is why I am getting so worried. So I guess another question is will they still try to access house if he no longer lives there and what do I need to do to prove this?
    The DCA was not just being nice about it, he has no powers to enter your property and even if he did, it wouldn't matter as only a bailiff can levy belongings. A DCA would know this full well.

    Yes, you just make an appointment at a solicitors and swear an oath. I suggest you do this sooner rather than later incase they choose to levy on the garden shed contents.

      Thank you again - I will try to make appointment for tomorrow. Lodger says bailiff's on holiday until 25th and that they are happy about waiting until then for the payment (but somehow I don't believe him - especially after them telling me yesterday action was imminent).

      It just gets better - he's had another thing from council today regarding an overpayment of housing benefit he's still not paid back (from about 3 years ago)

      Think I will just go and have a meltdown in the corner!!!
