    Yes all listed. How soon before the hearing do I need to send a response to the application and a witness statement? Can I send it with the letter saying I may not be able to attend?

        At least 7 days before the hearing for a non attendance note. Preferably 14 days before for any response to the application/witness statement

                Okay if you can't attend you should get the notice into the court and other party today.

                You really want to put something in telling the court that you made the other party aware (and when you did) of your technical difficulties providing inspection of the CCTV videos if that is their primary reason for the application.

                    I'd respond to the application and ask that your WS is taken into account as you are unable to attend. This is the basic guidance here - https://legalbeagles.info/forums/for...vance-at-least

                    They're asking to strike out your counterclaim and for summary judgment on their claim? and the application is being heard at the full hearing on the 21st, or is this a hearing specific to the application ?

                      Yes they are asking to SO my counterclaim and asking for summary judgement.
                      The 21st is a hearing for the application hearing. The full hearing is in April

                        Ok so I lost and my counterclaim was struck out ☹️. I didn’t attend the hearing but my Witness statement was heard.
                        I have received an N24 General Form of Judgement or Order informing me of this. Is this an actual CCJ?
                        it says that I have to pay the Claimants costs but it doesn’t give a date by when this should be paid.

                              Does the order state the applicant was successful- that summary judgment granted and your counterclaim struck out ? and that you must pay £xxxx plus £xxx for costs forthwith ?

                              or just the counterclaim struck and you to pay costs of that application, and the full hearing in april will proceed ?

                              probably need to see a copy or type out the full wording >?

                                It says the counterclaim is struck out pursuant to CPR 3.4(2)c
                                The hearing listed in April is vacated
                                The defendants do pay the claimants costs assessed in the sum of £xxxx
