    Hi All,

    i hope everyone is doing i wanted explain my scenario a little bit. I have been going through some mental depression and kind of let go of life and dealing with problems. It started with a couple of PCNs and then court letters and the bailiffs. Due to my mental health i have not been able to address problems in life hence why most letter simply just went unopened.

    Recently ive had bailiff at my door whilst i was at work demanding payments or removal of goods. Which i understand was partially my fault for not addressing my problems. Upon demanding payment and me being at work leaving my vulnerable parents at home i was forced to pay extortion amount of moneh. Fees went from about £300 to near enough £800.

    Is there anyway i can possibily claim back the bailiff charges baring in my the addon was extortion.

    Morning Mash,

    I'm sorry to hear you are going through a tough time, sometimes things get on top of us and we need to shut down for a bit. Are you talking things through with your GP ? Do you have help with your parents ?

    You probably want to look at your overall financial situation before getting too bogged down in complaints with the enforcement agents. If you get everything written down so you know where you are you can start going through and ensuring things are on a level and under control and there won't be any more escalation. Feel free to post about anything here, but if there are multiple debts/issues you are dealing with you might find it worthwhile getting an appt at your local CAB or having a chat with Stepchange. CAB are better at looking at your overall situation, not just debts, and it's face to face appts which can really help.

    Are there other debts or is it just these PCN's which have escalated ?

    Are there two PCN's, one has gone to enforcement agents ? What's the status of the other one ?

    I'll tag ploddertom with regards the bailiff fees. Do you have a breakdown at all ? Is the £300 the amount that the CCJ was for? Then warrant fee, letter fee, visit fee ( which I believe comes to around £400 ) And who is the bailiff company ?

      You should have had a Notice of Enforcement - charge £75 - not negotiable. If you did not respond to this then next
      You will have an Enforcement Visit - charge £235
      No more fees can be charged unless they have taken Control of Goods and proceeded to remove them in which case a Sale Fee may be applicable.

      Sorry to say but I do not think you have recourse to a refund on these fees but you should as a matter of course ask them for a breakdown to make sure you have not been overcharged.

        Did the Enforcement Agent divulge your information to your parents without your knowledge/permission? If so a nicely written letter to the ICO, copied to the following:

        TEC at Northampton County Court,

        Local Authority issuing the PCNs

        The Enforcement Agency charged with collecting the debt.

        You might not get your fees back, but they will be in a hell of a lot of trouble.

        PS Used "Signed for" service from Royal mail, so you have proof theat whoever you write to has received the letters, then follow up with a telephone call/email within 7 days.

          Hi Guy

          you all have been so helpful ive just had another bailiff turn up at my door from Marstons this one i honestly did not receive any letters about this. I wasnt able to into work today because ive had a panic attack and this is just getting worse for me. S there any service where i can find all my outstanding debts.

            For a different debt ? Do you think these are all from PCNs? If so they would have gone to a CCJ before bailiffs could get involved so get your credit files accessed and check any judgments on trust online.

            How did you leave things with Marstons ?

              Okay - Register of Judgments is - https://trustonline.org.uk/search-yourself

              But before paying for that check your free credit files... there's 3 credit reference agencies you should check - Experian, Equifax and Callcredit(TransUnion)

              They all have free access available through the following sites;
              Experian - https://www.moneysavingexpert.com/creditclub
              Equifax - https://www.clearscore.com/
              Callcredit https://www.noddle.co.uk/

              You want to look at the Judgments section - most have a bit of guidance when you sign up. This should give you a good overview of what's hanging about that you don't know about and can then start getting it dealt with so you don't get any more surprise visits.

              The CCJ's may be at an old address so use that for checking the register if it might apply ( have you moved in last couple years?).

                If they are Council PCNs then they will not show on the register and they must be dealt with differently to PPC tickets.

                  Also i called phoenix to find there is another outstanding fine and they dont want to accept any payments plans and they are saying it is in enforcement stage. They want someone to come around to collect full payment.

                        Ahhhhhh them.

                        Okay so these are council parking fines - have you contacted the council to find out what they are as yet ?

                        Considering the amount of stress this is causing you it might be worth seeing if you can talk to or get an appointment with CAB to help you get things sorted out.

                          As of right now ive called up the local council to find out about all the fines i have outstanding. Also the transport for london as i am writing this message im consolidating all my fines which is costing near enough £3000 or more. Is this even legal for a person to be fined this much.

                            Ouch. All for parking or is there bus lane type stuff in there too ? What period is it over ?

                            Did you discuss the amount of stress you're under and depression with them and have they put a halt on enforcement so you can get back on top of things ?
