  • Small claims solicitor needed

    Hi all first time post hope I put it in the right place,

    Looking for either a legal advisor or solicitor in Liverpool England for a small claims case were I have to attend a hearing on 31st may. Most of the ground work has been done by a previous solicitor who has now decided to go incommunicado on me.
    Basic sum up of the case is me Vs ex partner and a missing CMS payment. I went from informal agreement to formal agreement and one payment was missed due to being told by CMS to wait until formal agreement is in place. Ex has been informed that this case has no place in small claims but she is still relentlessly persuing the action.

        Who advised you that it has no merit or place in small claims court?

        You entered into a contract verbally with your ex to make certain payments and then have not fulfilled the contractual terms you agreed. It doesn't matter what the payment was for and if ex can evidence you are in breach of contract they have every right to pursue the matter.

        As long as the claim value is below £10,000 then if they are claiming breach of contract the County Court Small Claims track is exactly where such a case should be heard.

        If you think you have basis for contesting jurisdiction then your solicitor ought to have done that on form N180 when they completed it.
