      I am currently having CBT therapy and on anti depressants and mental state is not great I did something really stupid and out of character I shoplifted over £100 work of clothes from primark by mistake they have given me a slip that I will get a fine in the post and also they didn't call the police but they reported the crime

      I wanted to ask if this has any bearing if I want to have a DBS check done for future jobs? This is the first and last time it's happened

        It will not be a fine. Only courts levy fines
        It is an invoice for imagined losses and can be ignored.

        IF the incident was reported to the police, and IF the police do nothing, it is nothing more than an allegation and should not appear on a DBS check

          Thanks Des 8 sorry I’m just really anxious it was the first time and I made a stupid mistake they where talking about a crime reference number and was calling the police just to scare me but the manager cancelled it and let me go they have banned me for life from primark and 1 year from the shopping centre

          i work and don’t want employers to find out and show up in my enhanced dbs check and will the police turn up to my home as they took my address?

            The police will not be involved at this late stage.

            Being banned from Primark i would see as a benefit but in fact it is almost impossible to enforce.
            If you did go into a Primark store and were spotted, as long as you were not committing a crime all they can do is to ask you to leave.

            Your employers will not find out.
            There is nothing recorded against you on police files so nothing to show in even an enhanced DBS check

              Thanks for this it’s just they had a crime reference number and then the manager himself phoned the police back to cancel them coming as I cooperated with them and they let me go with the ban in place and told me to pay the fine

              will it still show up I got caught due to the crime reference number? Or will it be classed as an allegation

                Unless you heard the other end of the phone call it could just be a well rehearsed routine that only gives the impression of a conversation with the police. Could be the office down the corridor! Or nobody at all

                  They also said if I enter the shopping centre and primark they will call the police to arrest me or get escorted off

                          The warning was from the store manager and security of the shopping centre they had reported to the police as they said they had a URN Number but they cancelled the police coming and let me go with the ban and slip from rlp although I didn’t get arrested will they have it on there database??

                            No, they have made an unsupported allegation which has not been investigated or corroborated by the police.

                            If this could affect you, what is there to prevent anyone making allegations to the police, then withdrawing them but leaving a marker on police records?
                            That would be grossly unfair.

                              Hi so does that mean there is a chance it’s on there database and this will be grossly unfair?

                              As you make make an allegation but when you retract it’s not proved as such so therefore as they didn’t call the police and issued a ban it’s dealt with at shop level?

                              they kept saying it’s a civil matter what does that mean? So many words used

                                No, I was showing that to put uncorroborated allegations on a database would be unfair and so does not happen

                                In the UK there are two legal systems
                                One is criminal, the other Civil.
                                Criminal seeks to punish for offences such as theft, murder which are basically covered by Acts of Parliament and are offences against the whole of society
                                Civil law is concerned with disputes between individuals eg contracts and doesn't involve punishment

                                In your case they will be claiming that your attempted theft has caused them losses eg in staff time.
                                They can only claim these perceived losses through the civil courts.
                                The last time they tried this they lost as they could not substantiate their claim as it was entirely imaginary.
