    InJune 2016 one of your salespeople came to my house to offer to my a course of electrician and during thevisit it appears I signed a regulated consumer credit agreementwithout anything being explained about the potential consequences ofthis. I have studied and passed 8 modules and am very disappointedwith the service I have received from train4job I signed up to the course because I was told Icould study at home and through practical learning and I would be aqualified electrician within 12 months. This clearly was not true.Therefore I would like to withdraw from the course with immediateaffect.

    Inthe case I looked into, the person selling the credit did not have alicense from the Financial Conduct Authority to sell credit away frombusiness premises cause she did in my home. Nocredit checks were carried out and no affordability assessment madeas are required by law. i dont virtually no qualifications and no permanent fixed address. Theydidn’t even ask for my date of birth.
    She told i would be stupid not to take thisopportunity and put under emotional and psychological pressure over second day to sign. she was told there were a limited number of places she was competing for and rushed to sign what turned out to be a fixedterm loan agreement. sHe was not given the opportunity to readanything before signing the form and no cancellation rights wereexplained. the company for get de credit is carnegie consumer finance
    Allthis is illegal.


    please help my with what i could do i am spanish and my english is bad and i need to do something about this cause i very sure this is a illegal

      Have you just reached the part of the course where you need to attend a practical training couse which is for 6 to 8 weeks and a long way from where you live ?

      Is this letter one that you have written to the company about your own case ?

      Just notes....feel free to ignore.

      They are part of Metropolitain International Schools - FCA ref 730455 - authorised. In June 2016 they were interim authorised(till July '16) but with 'No right to canvass off trade premises'.

      The finance company is Carnegie Consumer Finance - FCA ref 718804 - authorised. - In June 2016 they were interim authorised (till Dec '16) but with 'No right to canvass off trade premises'.

      There is an odd bit in the FCA rules which they try to get around the ' no right to canvass off trade premises' which is why they make two visits and the credit agreement is dealt with on the second visit. I think that can be argued invalidates the agreement. (CCA s48 )

      However, that aside, your primary argument is that the course was missold and missrepresented to you - Consumer Protection from Unfair Trading Regulations 2008. The finance agreement was entered into at home via a broker ( Metropolitain act as a broker for Carnegie ) who wasn't authorised to enter into the agreement (due to the no right to canvass) - that they breached the FCA regs, the FSMA 2000 ( regulated activities order), and the Consumer Credit Act 1974 (s 48 and various others) and also The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 regarding the 'service' contract.

        I am in similar situations , just the schools name is https://newtradescareer.co.uk
        and the loan was financed by the Carnegie Consumer Finance.
        The guy came to my place, made 2 visists, everything was kinda convincing. but far from truth, no credit checks or anything, he did ask me about my afordability, but there and then mentioned( noone checks that ,so just put down leess then it is) after that we signed papers and he left me a colage number, and some books to study. Now it is like 4 months down the road, I have finished 4 online modules/ testes. And things kinda has changed lately, with work and house, and I tought I'llcancel the school, long story short ,I caled them up.
        1st to the collage( they are saying I can't cancel it, and I need to call to the finance company.
        So now I called to Carniege(finance company) , and they say I can't cancel it untill school, cancels my membership and returns the money to them.
        at this point things started to seem suspicious. So I did research, and aparently there are many, many other people who are in this situation.
        So I signed the agreement on 15 of February, and now when it all kinda starts to sink in, I had a second toughts about it.
        But they say im left without any choise than pay like 7+ thousand.
        Has anyone ever got out of this, and what are the legal options here.?
        Please help. any information will be highly appreciated.!

          Its the same people as Green 360 ( they still have New Trades Careers as their trading name too - is your agreement with Ménage or Green ? or someone else ?)


          Carnegie are authorised by the FCA as are Ménage... they also use Caledonian ( who are also the same people )

            Well I'm g I have signed 2 agreements. One is with carniege consumer finace.
            and other one ,is with New trades career - and on other side , on cancellation notice ,it does say Green 360Ltd.
            I'll add pictures.

                Okay. You are tied to the credit agreement - much like if you'd purchased a laptop / sofa on credit - you wouldn't be able to return the sofa / laptop after 4 months unless there was something wrong with it and/or it was missold to you.

                Other than your circumstances changing is there any other reason you don't feel you can continue with the course?

                Were you aware you were taking out a loan of £7.8k ?

                Lending money without checking affordability is known as irresponsible lending. You can make a complaint about this to, in the first instance, the broker ( Green 360 Ltd ) and the lender ( Carnegie ), with a view to taking the complaint to the FOS. ( FCA rules https://www.handbook.fca.org.uk/hand.../?view=chapter )

                What exactly were the affordability checks undertaken? He asked you your income? expenditure ? Did he write anything down? and did he change figures you told him ?(eg did you tell him yu paid £500 a month rent and he wrote down £400 or anything like that) Run a credit check through the credit reference agencies?

                A subject Access request is a good idea - one to Green 360 Ltd, and one to Carnegie. Subject Access Request Letter

                  Can't realy think of any other reason. Just doesnt seem convenient and necessary. I applied for welding, and I got the job as a welder. Seems a bit useless to proceed.

                  I knew the amount of loan.
                  He did ask me , quoting-( a rough number) , of income and outgoings, just to make sure I can afford it, it was al verbal between us, and as far as I know there was no credit checks , and no credit references done.
                  There was a point when I mentioned, that I remembered some extra expenses, and that was when he just replied (it doesn't matter as noone is actually going to check it) only reason why they are asking, is not to enrole people who has no affordability at all.
                  Then he made a call, and gave me the phone, there was a lady ,who wanted me to confirm the numbers about my income and outgoings.
                  after that papers signed and he took off.

                    Affordability checks normally only take into account the priorities - so rent, utilities, council tax, etc. so if you in essence completed an income expenditure form - did you show them a payslip? - it might well pass affordability rules... you could still do a SAR to see whether those details were passed on to Carnegie etc.

                    You could maybe chat with your employer about the course and the qualifications it leads to, to see if continuing with it might assist you in your career - if they are qualifications worth having... you could also talk to Green 360 whether the assessments for the practical elements could be done at work ( is it an NVQ qualification?) by an assessor rather than having to take 8 weeks or whatever out of work to attend the ERR college for practicals.

                        Me too. Feel so stupid for signing up.

                        I haven't heard from them for months now.

                        Tried logging in but it won't work.

                        They won't answer emails or contact requests.

                        Thinking about cancelling my DD they will likely get in touch then.
                        What are my rights?

                          I'm another mug who fell for this scam £180 per month im paying. I've never even got online to start the sodding course.

                          I just feel trapped and i still have 2 years of paying this £8k debt.

                          I think i will just cancel paying the Standing orders.

                          I'm not Legally bright and dont understand laws bylaws to wriggle out of the contract etc

                          If anyone can help it would be appreciated.

                            Did you end up canceling your direct debit??? What happened if you did?
