    thank you both for responding. My husband pointed out that we've been married for 6 years and I've never dealt with this debt in all that time. Would it matter that I've already made two payment instalments to Lowell?

      As he had not made the payments then if you did, he it would construde has not acknowledged the debt I am sure? await others will also comment no doubt!?????

      Of course Lowells will try and dispute that for a while hoping you beleive them , they are worse than a 1 year old kindergarten company. run by bigots oopppssss been told before not to tell the thruth it hurts them>

        As Charity says a SAR to shop direct would be a great idea as this would give you details of when the account was defaulted, when the last payment was made ( before you started again) . Once a debt is SB it can never be undone so any payments made after will just be gifts to the DCA. What you need is that clear 6 years

        There is an appeal going through the courts at the moment which may help decide just when the limitations period commences, if the appellant wins it will be bad news for many debtors . Until that is decided we soldier on

          Thanks for replying all. I have just spoken to Lowells again(for my sins) and after gleaming absolutely nothing from them despite a 20 minute phone call, I have been informed that my last payment was April 2011 and they issued court proceedings march 2017. I have no idea if this is true or not as I can't remember that far back and I never received any letters from the court.

            does your credit file show a CCJ? check it and see, do not talk to lowells they are just paid telephone operators whose job is extraction of monies = jockjey / phone.

                  Thank you. That has been suggested by another poster too, I will send that off to shop direct today. What should I do about the fact that lowells are saying that if my payment is not paid on 16th July it will automatically go to a default ccj?

                    When you arranged the 6 months installment payments was there already a court claim issued against you? ( Have you rung the court yet to find out?)

                    Seems Lowell said they had issued but you never had a copy of the court claim, and you sorted out installments straight away you received the letter from Lowell.

                    You need to know though, if they have issued then they could apply for a default judgment, if they haven't issued then they couldn't.

                      Also, you should be able to obtain historic bank records from whichever bank you were using at the relevant time.
                      That might help shed light on things.
                      They normally charge a small fee.
