    hang on a minute before you make any offer

    I would not under any circumstances make an offer just at the moment, lets have a look and see what they can produce.

    Just so you are aware, you can make settlement offers at any point up to them winning a judgement and that may be less than your 50% thought and even over an instalment plan.

    In addition , so long as you pay any judgement within 28 days it does not appear as a ccj

    Remember they have to win first and that is no small feat.

    I am waiting for a train at the moment but as soon as I get home I will find the LBA response and post it. Should be within 90 mins

      I have read your thread and while I am not really experienced at telecoms claims it is always worth trying to see them off

      I would send them this
      Dear Sirs
      Ref: xxxxxx
      Thank you for your letter dated xx/xx/xx. As the letter contains a threat of litigation, it is being treated as a formal letter before action. As such, I refer you to paragraph 3 of the Practice Direction Pre-Action Conduct, which states: “before commencing proceedings, the court will expect the parties to have exchanged sufficient information to (a) understand each other’s position; (b) make decisions about how to proceed;”
      Paragraph 6 states “the parties should exchange correspondence and information to comply with the objectives“ and Paragraph 6 (c) of refers to “the parties disclosing key documents relevant to the issues in dispute.” My request refers to the documents I require to obtain the necessary information to assess my position in this case.
      I require copies of the following:
      1. The original agreement
      2. The Default Notice
      3. The Deed of assignment
      4. The Notice of assignment
      5. Statements of account

      These documents would be expected to be supplied if proceedings were issued and would likely be in your possession if you were issuing a claim. If you consider that there is difficulty in providing a copy of a document, please identify that document and the reason.

      I shall being able to provide you with a full response to your letter within 14 days of receipt of the documents listed above and also reserve the right to refer to the contents of this letter if proceedings are issued without first providing copy documents to me.

      If Lowell did offer you such a large discount it might mean they are not confident in winning or it might just mean they want shot as it really is a relatively minor claim .

      If you have not been responding to letters at all, they may also think you will not respond to this and they could get a default judgement all nice and easy like

      Obviously I do not know how Lowell think, sometime I wonder if they know how to think but I digress

      get that letter off by Royal mail signed for to the solicitors

        Hi warwick i appreciate that alot thank you i shall get that sent to them tomorrow and will see what sort of reply i get. I was also thinking the same thing regards to 50% off ither thers something not rite or they just want to get rid. Thanks again.

                                Interesting

                                I am thinking the statement shows charges and then credits so a bill is raised on 17/1 and then paid on the 31st . This goes on until you stop paying and they add on the total costs

                                Interestingly , although only a few pence really, the ending balance is different from the amount they are claiming as the principle debt - not sure if that can be argued

                                Are the other documents they are waiting for the ones asked for in the letter suggested in an earlier post?
