  • Cooling off period - Will I be able to cancel my agreement with Purplebricks?

    Hi Beagles,

    My partner and I made a decision to advertise our house for sale with Purplebricks. We have since been approached by a local investor who wants to buy the property, I'm now wishing I hadn't instructed PB earlier in the day. I paid upfront (£849) but am wondering if I have a right to cancel with no costs incurred (or at least minimal costs) as I am within the 14 day cooling off period as stated in the Consumer Contracts Regulations 2013. I'm just not sure if the agreement is covered by these regulations? Technically the property isn't advertised anywhere, all they have done at the moment is come round to value the house and take pictures.

    Any help or advice? The grounds I hope to use to cancel I believe is covered by the Consumer Contracts Regulations as I purchased the services online and therefore at a 'distance' and am therefore entitled to cancel within 14 days of instructing them?

      Thanks Enaid, I did see that post but they paid via the pay later option which has a different service agreement as it's provided by a third party called 'Close Brothers'

        Have you made contact with them to cancel? Helpful to others who can advise when they can see the reply from Purplebricks

          You do have the right to cancel within 14 days. However they may charge you for the valuation and pictures work undertaken.

          They should have given you a notice of your right to cancel and a cancellation form with the contract - maybe check through your emails from them? If not write to them and tell them you wish to cancel...
          In accordance with my rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, I would like to cancel the contract made on XX DATE 2017.

          I require written confirmation from you that the contract has indeed been cancelled and that my payment will be refunded in full.
          I am presuming of course that the investor didn't contact you due to any contact made/advert placed by Purple Bricks.

            Thanks Amethyst, I will be contacting them later today and will update this post with any outcomes. Yes the investor did not make contact due to any information seen or contact with Purple Bricks. Hopefully this information will help other users in the same situation!

              Quick update - Spoke to Purple Bricks tonight and they 'see no reason' why it should not be a full refund as the property has not been listed for sale. They will be in touch in a few days to confirm (going to make sure this does not extend the 14 day cool off period)

              Will update the post with further updates as and when they happen.

                What was the outcome of this please? I signed up with PB last week and just seen them on Watchdog, now I am panicking.

                  Yes I was able to get my money back, this was only possible due to the fact that my advert had not been made 'live' yet. They had come round to take photos and create an initial draft advert for me to review but it was not published.
                  It also took 3 weeks of me chasing to see my money returned!

                    Luckily I have had an offer on my property within a week so all looking good and I've been happy with their service so far. Think I panicked after seeing it on Watchdog.

                      I was wondering the same. 12 days into cooling off period. Photos taken a week ago and have heard nothing. I texted my contact yesterday asking where they were and she said some were being released yesterday will call me back but never did.
                      I am getting concerned they are too slow and only interested in initially obtaining clients
                      Will emailing my purple bricks contact be sufficient or have I to email someone else too?
