I need urgent advise please. My partner has a debt now charged to the family home by a creditor. I have registered a home rights notice because we have 3 children . The interim order was made final last week l, received a letter today that they are going to apply to court for a forced sale except he proposes a payment plan. This is the same company that rejected an IVA we already had in place. What are my options?

Did you defend the final charging order and were you able to make representations to court?
How much approx is the debt ?
Is there much equity in the property?#staysafestayhome

My partner did not go to court for the initial interim charge but we responded to the court after with reasons we will contest it. Apparently, the last hearing he attended was to make the charge final, Not to listen to his defence. It's over 300,000 which effectively wipes out the remaining equity. The debt was due to repossessed buy to let properties during the crash of 2008.
