I think as I have not received any more advise do I need to get in touch with bw legal . at the moment I am dreading a knock on my door. please can some one reply.
From what you say there is a CCJ. If it was a Default Judgment or you didn't attend any hearing this was probably a "Forthwith" Order which means the whole lot is due and payable unlike an Instalment Order where you only have to pay the monthly amount agreed after providing the court with an Income and Expenditure Form.

It may be possible for you to make an application for a redetermination of that Order to manageable monthly payments. Once an Application to Vary has been made that should mean the Eviction Warrant can be suspended.

There are several bailiff experts on this thread who may be able to advise you on how to manage this situation.

I can also see that there may be a possibility of an Application to Set Aside the CCJ if it was obtained by default, but there would need to be a good reason such as the summons was sent to an incorrect address or you didn't receive it. You would need to demonstrate to the court that if the CCJ were to be set aside you would have good prospects of defending the claim.

The main thing is that any new application to the court may thwart enforcement action by the bailiffs.

You could do without this stress just before Christmas.

        Di
