    Hi all and thanks for anybody reading this..

    I've been sending letters back and fore to restons who are acting on behalf of orange dating back to 2009 but arrow global bought the debt in 2012 I've checked noddle and the account was defaulted in 1-7-11 I can't even remember having a contract with orange I've explained this to orange asked them to prove it (£484) I've sent the cca letters long with the £1 cheque and just received a reply today as follows

    we we write to your recent correspondence

    please note this is being returned to you are we are not the creditor we are a film of solicitors in any event the original creditor orange does not retain copies of agreements as there is no regulatory act that requires them to do so

    we we now require proposals towards this outstanding balance (which I haven't said that I owe it) please complete a financial statement by 10th October 2016 failing which legal proceedings may be issued


    pleas have anybody got any advice for me thanks in advance

    Did your original account with Orange include purchase of a handset as well as your mobile minutes/data ? Or was it a package that included a free handset?

    What happened at the end of your contract with Orange ? any issues or simply a stopping paying it ?

    The CCA letter may not apply to the mobile phone service contract unless you had credit to buy the phone alongside it. However the agreement and statements showing how the sum claimed has accrued should be available from Arrow ( or indeed, Orange) under a Subject Access Request.

      To be honest I think there was a handset I remember paying it for about 2 months then lost my job and couldn't afford it I simply stopped paying it I think a lot of the debt are charges I would be willing to pay the origanal amount however the contract was taken on 13/08/09 then 2 years later they give the default I've had no contact or payment given to orange/arrow global/or restons since I couldn't afford to pay it I don't know where I stand

        Okay do you think it was a 12 or 18 month contract ? Could be important as to whether the debt could be argued to be statute barred, if you stopped payments in say December 2009, then a couple of months for the cause of action to arise... two years seems a long time to wait to default you, so I do think a Subject Access Request to Orange would be useful, as well as a letter back to Restons stating you have done so and that you believe the debt to be statute barred.

        On your credit file does it show the date of default only? anything before that ?

        Could you post the prove it letter that you sent to Restons up pls, then we can give you a hand with a reply to their response and with a SAR to Orange ( which would cost you the statutory fee of £10 (cheque or postal order ).

                OK now it seems Arrow Global own this debt and Restons are acting on AG's behalf.

                This being a telecoms " service " contract there I not a CCA 1974 regulated credit agreement, have you had a response from AG or Restons?

                    The CCA request should have been sent to AG not the solicitors.

                    When did payments actually cease on this account Orange were/are notorious for leaving delinquent accounts laying on file without defaulting so the cause of action may well be much earlier than the default date registered on the credit file.

                      I'd say payments stopped sept/oct 2009 don't think I actually made 1 payment but I'm looking to buy a house soon and the last thing I want is a ccj also I rang arrow global and they actually said to me all correspondence must go through restons
