    Lowell and BW legal set aside

    Hi, I had a default ccj against me in 2014 that i had know idea about until a couple of months ago I applied to have this set aside 4 weeks ago and yesterday I received a email (see below) from BW Legal asking me to sign asap the thing is is this normal should I hear something from the Court where I applied,
    Any help please

    looks like the consent order is saying that the CCJ set aside, and the claim is withdrawn (although they say dismissed) which means that's the end of that.

    I can't see any problem with it if that is what you are looking for, just means your application fees for set aside can't be recovered from them and each side bears their own costs.

    I would get them to provide you with a copy of the consent order signed by them as well. If you can email it over then ask for the signed version by email to retain this for future reference.

        Just make sure not to sit back and expect them to do you, chase them up on a regular basis as its your application not them so get a signed copy and then forward that to the Court also just as a cautionary measure until it has been accepted.

          Thanks for all your help the the court sent me notification that Judgment was set aside they also sent me a Notice of Proposed Allocation to Small Claims Track with a Directional questionnaire. Anyone tell me what I do with this as I ain't got a clue.

            I've replied on another thread of yours on the assumption that it is for this same claim (is it?).

            If so then it may make sense to merge the threads.

            So if the claim was dismissed I'm a bit baffled as to why the court has sent you a DQ.

            Maybe call Truro County Court on Monday to see what's going on. Hopefully it's only a case of crossed wires.
