  • PCN received - 52m Failing to comply with a prohibition - is there a defence to this?

    I hope you are able to help with this 52m PCN issued by a London Borough.

    Date of Notice 01/07/2016
    Received 02/07/2016
    'On 20/06/16 at 16:09 The alleged contravention was noted by enforcemnt officer (number) who was observing real time images from a roadside camera.
    The penalty Charge of £130 is now payable etc... within 14 days 50% discount etc...

    Photo clearly shows the family car being driven (by my son) along a named street but other details are not forthcoming either from the pictures supplied, or from the alleged contravention description.

    I have looked at Google streetview and worked out that the car is being driven on a one-way street that has a 'No motor vehicles except buses and for access' further back where the road divides.

    I have to say that you really have to look for the restriction signs (there's no advance warning as far as I can see) and that you probably wouldn't realise until too late. The left turn that you apparently should take gives the impression that you are driving into a service yard behind an office block (the road passes under the building).

    My son says he was following instructions from his phone satnav as he was in a part of London he had never driven in before (we live in rural Bedfordshire) and that the area was totally unfamiliar to him.

    The cynic in me feels that having the camera sited where it is is probably a good fundraiser from unsuspecting motorists unfamiliar witth the one-way system.

    Is there any defence or mitigation that anyone can think of from what I've posted?

    I include a screenshot of the street where the road divides - my son carried straight on whereas he should have turned left under the building. He was apparently following a bus at the time an says he didn't see any restriction signs.

        The sign says except for buses and for access ? What is the legal definition of ' for access ' ?

          I believe it is land adjoining and premises along that route where access is not available other than that particular route. But Yes the Pepipoo forums might be a better option to get help as they are probably more knowledgeable. Forgot that M1 does not know much about penalty charges!

              I have just had fine for turning into street whichjust said car enforcement cameras sat nav sent me down I did not know area and was a bit lost there were cars on both sides just found out it was only for buses can I appeal?
