    Please help. To cut a long story short I had a catalogue with very who charged astronomical interest charges. I ended up falling into debt with it. I tried making payment plans with them but they just wanted more and more. Back in July 2011 I requested the cca . They did not have one as the account was taken out in 2003. I stopped paying anything to them from April 2013. I have now received a letter from bw legal to say they are intending to take me to court fo r this debt. Can they do this without a cca? I've read about the 3 letter process but because I've already done this back in 2011 should I do it again? I'm at a loss as to what to do next really. Any advice would be greatly appreciated. Thanku

    No don't do it again ( 3 letter process is just tosh I'm afraid) just send a CCA request to Lowell ( presuming it's lowell?) and a letter to BW Legal, something along the lines of thank you for their letter, you;ll be happy to discuss the alleged account further with them when their client provides the relevant documents, despite having requested them previously from ?????????, you are sending a further formal request for a copy of the alleged credit agreement to Lowell?? as creditor, together with the statutory fee £1. You'd also be grateful if they could send you a copy of the original notice of assignment as you have not previously received any notice that the account has been assigned to Lowell, and you have no record of having received any default notice as required by s.87 of the Consumer Credit Act. You'd also appreciate a statement of the account so you can check your records and consider your position. Should they bring court action at this stage without any documentation or evidence of this debt it will be defended.

          Hi.soz to be a pain. I did the cca thing back in 2011 and I've got the letter saying o agreements found. That's why I wondered about doing another one .
