  • Sale of goods act 1979

    Hi all i now have an option to request a default judgement on a ltd for not filling a defence on a claim 40k is the judgement
    worth anything would it be easy for their solicitors to set aside.

    You would need to give a lot more info to get the best advice on here plenty of help but they are only able to do so on the facts.

    If you get the judgement do you expect them to pay you

      40k Motorhome not not satisfactory quality i expect their solicitors to attempt to set the judgement aside would this be a irregular
      judgement

        It really depends on whether the claim did go to the correct address, correct entity etc, and whether they have a reasonable prospect of success defending the claim - presumably they have failed to acknowledge or defend the claim ? I'd usually say give it a week after their deadline before filing for a default judgment - have you heard anything from the defendant at all ? Maybe also check with the court if they have received anything manually and not put it on the system.

          case lodged dec 2015 I failed to supply particulars of case to their solicitors they failed to submit defence details ,found out this week their solicitors tried back door with court to get case struck out went before judge march 2017 was rejected and they were told to put in a application they have not responded ,tipped off by court to request default judgement.
          Not sure if should be discontinued and represented new case naming distributor firm and its
          5 directors and the manufacturer and all their directors why not make a circus out of it.
          Or stick at the default judgement where it is likely they will achieve set aside the you request
          single joint instruction expert witness.
          Where I do not have experience how easy would it be to obtain set aside if I have agood case.
