    Re: Credit4Cars Ltd/Avelo/ShooSmiths Solicitors

Ok 3 years ago I went to C4C to get a car, and signed agreements to pay £340 a month,so for this period of time a few payments were late but I found away.. now the company went in to liquidation and did hear from anyone for whom I had to paid, then shoo smith contacted me once and we didn't come to any conclusion as to reducing the monthly payments and it was left, I also work away from home a lot and they had my contact details and still didn't hear anything up until now,I'm been taking to court for the last £2000 and odd after paying over £10,0000 and they are now telling me to give back the car or we want the money in full how is this right, I am at my wits end and stress levels are through the roof.i never only said I'm not going to pay I just needed a reasonable conclusion.i am also out of work and seriously need help.

      Re: Credit4Cars Ltd/Avelo/ShooSmiths Solicitors

      Hi,

I stupidly agreed to take a car off credit 4 cars back in December 2014, when the car arrived the fan blowers did not work ( Alarm bells started to ring) so they came back and picked up the car dropped it back off a week later only to find that the fan blowers did not go off when the engine was off causing the battery to drain. my heart sank, surly it was supposed to be a happy experience picking up a car? I just wanted rid!! As my credit is not too good and being desperate for a car this seemed like the only option! it was a ford focus titanium model had 94000 miles on the clock and a 08 reg plate. I paid regular monthly payments of £376 never missed a payment. they told me when I took out the finance that it would help me build my credit up and that after the terms I would be able to walk into any showroom and get financed on a car. a year passed and there was nothing on my credit file. I even paid a £2000 up front payment to clear my debt off quicker as I came into a bit of money then to be told I didn't have to pay for 4 months due to this payment which I thought was very strange why couldn't they just take it off the balance? and then the dreadful day came when I was driving down my local street with my son in the car I lost all control over the car and the CV Joint snapped in half making me loose all control of the car and veering into a lamp post! luckily we were fine but the car had to be towed away as un roadworthy. all that money I paid gone! no car I wrote a letter to avelo for cars as it stated in my contract I could terminate the agreement after I paid so much! and stated I didn't want the car and to terminate. I heard nothing back I was relived I just got rid of this death-trap! then Shoesmiths started contacting me saying I owed over £7000 and I now have a CCJ for over £8000. as the company credit for cars went bust they say they have no evidence of this letter I sent and want the full balance. how can I appeal this? I feel distraught.

It appears from Companies house that Avelo was taken over by a new Director in March 2016 about the same time all the other companies went into Administration ( Liquidators are CVP Global LLP. ) . Avelo used to be called Credit 4 Cars (2015) Ltd.

        Avelo's website states

The timing all seems to fit with them having had their interim permission licence withdrawn. ( EDIT: On checking yes credit4cars licence has lapsed - Credit 4 Cars Ltd Interim Permissions reference number: 644685 trading names of One Stop Car Sales, One Stop 4 Credit, Credit For Cars, Www.Credit4cars.Co.Uk, One Stop Car Shop ............... and Avelo don't seem to ever have had one - hence them using Shoosmiths )

Can you explain how contracts have been breached and what the allegation of fraud arises from ?

        Sharon

Where is it saying you have a £15k ccj against you? On your credit file or have you had a letter from the court? Do you know who the ccj is from - Avelo ?

Ahh yes these cars had that bonkers cut off system on - Avelo have no control over that as far as I know so I'd just use your car as normal tbh.

Have you had any correspondence at all since c4c went under and stopped taking payments?

                  Hi
I took a car finance out with credit4cars in 2014 after separating from my ex husband and I maintained my payment with them until I fell behind with my payment due to going through financial hardship. I wasn’t even aware or neither I was informed that the company went to administration at all until shoosmiths llp rang me asking a demanding payments from me. In December 2015 I had an accident and the car was written off and then my insurance company decided to cancel my car insurance and I was unable to drive the car as it wasn’t worth of repaying. Then in March 2016 council had a report saying the car is dangerous for kids and it needs scrapping and they came and took the car without my knowledge and I rang shoosmiths and arranged them to collect the car as I cannot afford to keep the car as I was moving out of town and I was told that the car would be taken from the council on the date they provided and never heard from them anymore but I do fear it will come back to me and I went into my iva payment
