    Hi,
    I recently had a PPI decision upheld from Lloyds. The loan was held in joint names. The payment offered was divided between myself and my deceased wife (passed away 20-1-07). There was no estate and no will so I, as next of kin, assumed the role of Executor. My half has been paid and a deduction made to a Claims Company plus VAT has been paid. The Claims Company have said that they will pursue my late wife’s half if I were to send them a copy of the Death Certificate that I do have. They went to great pains to emphasise that I did not have to do this and this makes me suspicious. Obviously, my late wife can no longer give authority and that would have to be given by me. Presumably Lloyds cannot disclose financial information without a form of authority being signed. What is to stop me asking Lloyds for the money and then subsequently refusing to speak to the Claims Company?

    To clarify, the Claims Company wish to pursue this and will ask for 30% plus VAT if successful. However, if I pursue this then I will owe the Claims Company nothing or can they charge me for doing the legwork ? ​ How will they know if I have been successful?

      Just had yet another phone call - Can I tell the Claims Company that I do not want them to pursue this and then get in touch with Lloyds direct?

          Did you actually see a copy of the offer letter from Lloyds and have you spoken to them ?

          Probably worth doing that and getting any info from the horse's mouth, then deal with the CMC later.

          On paying the fee to the CMC, it really depends what you signed up for with the CMC. Presumably they were aware it was a joint loan and joint PPI policy and that your wife was deceased so they really should have sorted it all out at once.

            Thanks Amethyst. Unfortunately communicating over the phone proved too difficult so I've written instead. Its an interesting one and I'll let you know what happens.

              Still in a loop. Lloyds won't speak to the CMC who are pressuring me to chase up Lloyds . I really couldn't make myself understood on the Lloyds hotline. They were supposed to send me a form but as this has not been delivered twice I am assuming that this has been posted to my old address and again I literally couldn't communicate this. Might try with the Ombudsman

                  Have received the Declaration form and posted this back along with a copy of the Death Certificate. The Claims Management Company will doubtless claim their full fee even though I have had to sort out the conclusion (if there is one).

                    Still getting threatening letters from the Claims Management people. Do I post them a remittance 30% of nothing = nothing?
