  • Re be legal and Lowell portfolio

Hi can anybody give me some advise please. I have just been issued with a ccj from the county court business centre, stating a judgment was issued on the 4th of his month from bw legal who are representing Lowell portfolio 1. Saying I failed to return claim forms.

But I dint get any claim forms from the court or I would of responded due to already being penalised for this 6years ago and a difault already being on my credit report from welcome finance . I have gone through all my letters and can not find this. I phoned the courts this morning stating this and they're going to email me forms over with a fee, I also contacted bw legal and they said I have been order by the court to pay back £2949 with instalment of £80 a month and if I faile to do this I will have bailiff at my door. This is a loan I took out 8 years ago and if I remember it was only for a 100 pound, can someone please help me as I have 5 depends. Thank you

The court will be sending you a N244 form - the fee for submitting this is £155 or if you are on a low income you may be eligible for remission. Have a look through this post about set aside applications: http://legalbeagles.info/forums/show...lication-notes

Do you recall much about the Welcome loan ? Would be a very small loan for Welcome Finance if it were just £100 - was it £1000 maybe?

If you took it out 8 years ago do you recall how long you made payments to it for ?

If you were defaulted on your credit file over 6 years ago then it is likely it could be statute barred - did you make any payments since it defaulted do you know?

Hi thank you for getting back to me

sorry yeah for £1000 if I do remember correctly. don't remember much and I've moved since taking it out so will go in my attic later to see if I still have any letter from them. How can I found out if it has been statute barred? And I've made no payment since the difault.

        Hi amethyst

my bank has just informed me that the lone was for£1500.it started in Nov 2008 and the last payment was December 2009. I also looked on my credit file but welcome finance are not on it, but a difault from Lowell was put on ,on the 28.12.2014. For£371.00 dose that mean that's when they bought the dept? And I've never made them any payments. I am so upset with myself for not sorting my mess out a long time a go so is it best for me just to pay bw legal and except the ccj.
