  • Urgent assistance needed please

    HI everyone i have been reading this forum recently and to cut along story short my ex has left me with an unbelievable amount of debt and moved abroad i am a single mum of two young children i am trying to tackle these debts and have managed to do so successfully for quite a few i am struggling now with 3 debts and am looking to use this forum to seek assistance.

    this post i about a barclays career development loan that i am trying to obtain an agreement for i have not taken any loan for career development or signed any documentation or attended any courses, whilst with my ex he dealt with all the finances i am trying to establish how this loan came about and where the money went, so have requested a cc agreement which barclays have not provided , up until now in order to not lose my home and stay on track i signed up on a debt management plans and they have been paying all these companies .

    Barclays have sent me a letter which i will attach below. Any assistance of what to do next would be greatly appreciated as i really want to get out of debt and start afresh for me and my kids.

    So Barclays are refusing to send a copy of the credit agreement at all ?

    Think that letter needs responding to with something a little bit firmer regarding the requirements of the consumer credit act.

    Is the loan in your name or ex's name ?

    You could also send a subject access request to Barclays.

    Do you know of any training courses they were doing?

              Urgent advise Needed!BARCLAYS not providing credit agreement
              Hi Everyone

              Barclays are refusing to send a copy of a CDL credit agreement i requested the agreement and am sent the letters below either stating my balance and paid amount. BUT no agreement has been provided.

              I have tried complaining and get the response below, the loan was taken out by my ex i think and i am trying to get a copy of the agreement it was taken out sometime in 2006 from statements that have been provided i am trying to clear my debts and tackle them and they are not making the matter any easier


              Can anyone advise me what i can do next and what i should write back to barclays

                          I've had a reply from Barclays Lending Team, not really helpful just says that full credit checks are made on CDL applications so have asked again re CCA '74 regulation.

                              Career Development loans ARE Regulated under the provisions of CCA 1974.

                              Dear Mr Stanley,

                              I have been in contact with Barclays regarding my Career Development Loan and have corresponded with Kapal Singh a customer relations operative, enclosed herewith copies of the correspondence from
                              Kapal Singh On date I wrote to Barclays to request a copy of the Consumer Credit Act 1974 Regulated agreement relating to this account, however Barclays have been totally uncooperative with regard to this lawful request.

                              Further to a letter from Mr Jenkinson who titles himself as a " Decision Maker" it appears that Barclays believes itself to be above the law set down in the provisions of CCA 1974 and does not have to comply with my request for a signed copy of the agreement as this is " company policy" surely company policy cannot override statute law?

                              I am aware that if a properly signed and executed regulated agreement is unavailable a " reconstituted " agreement may be provided in response to a request, however this has not been offered.

                              I am enclosing herewith a Postal Order for £1.00 the required fee for a formal request made under sections 77/78 of CCA 1974 for provision within 12 + 2 Working Days from the date this letter is received a copy of the signed and executed agreement or a compliant " reconstituted " copy of the agreement.

                              I am preparing a report on the conduct of Barclays in this matter which with copies of all correspondence received will submitted to the FCA if this request is not complied with.
