      When is the hearing?

      Does your ex have representation?

      Have you already been to previous hearings where you got the original order that you're enforcing ?

        I have dealt with an American equivalent but the Americans call it a 'protection order.' In the American case I assisted a friend who was also a litigant in person. The matter was more complex as it was a person from one American state, ie Ohio trying to get a protection order against another state's citizen, ie Minnesota. Anyway, it really depends on the evidence you possess or the actual facts. Protection order type remedies have been around since at least the 80s in English law-related countries, ie Australia, Canada, USA, England etc. They are deemed on the whole to be successful unless the partner is psychopathic they generally are a brilliant way to stop domestic abuse type situations. For a non molestation order in England it requires proof of threats of violence or other abusive conduct, I believe If you have this there should be no problem. Make sure you have permission to bring your evidence to court. As far as am aware a non molest order is civil so it'll come under the Civil Procedure Rules (CPR). Ref: you're "extremely anxious and panicked," I do not know anything about you but be careful with your words, your conduct, control your emotions. Make good use of witnesses if you have any as third parties are good for proving your case, ie not just your word against theirs. What about police reports, neighbours hearing shouting, crying etc? Do you have any children, if so what is the effect on them, has their lives been affected in terms of they're nervous around your ex partner. Is your partner/ spouse being represented by their lawyer if so you'll be cross examined (try to make you look like you're the problem, may be), by his lawyer. Think like a lawyer, be objective, stick to the main facts. Make sure you know what is evidence - ie something a source that has persuasive power to convince a judge. Could the evidence be used against you, if so think twice about submitting as evidence. If you have not prepared yourself properly, ask for an adjournment.
