  • Help Sold CCJ

    Hi all,

    I am wondering if I can get some advice on my situation.

    I had a loan with Northern Rock taken out in 2007, due to my circumstance I haven’t paid the loan since July 2009. In April 2010 Northern Rock took out a CCJ with a charging order against my home.

    I hadn’t heard anything further from them on the CCJ until recently when I received correspondence from Marlin Capital saying that they had bought the debt. I sent off letters to Marlin Capital who transferred the chasing of the debt to Mortimer Clarke Solicitors.

    Mortimer Clarke so far appear to have sent me the original credit agreement albeit it is hard to tell. They have no statement of account which they say they are currently getting.

    I have previously received from them the Notice of Assignment, so I cannot dispute the debt over this.

    I would like to know if anyone has any advice on what my next move should be, the defualt end date is April 2016 and there last letter they sent, said I could have 25% off the original debt if I paid it before 10th March.

    You already have a CCJ and a charging order against your property. What is Marlin.Mortimer actually asking for ? are they looking at further enforcement or applying to court for an installment order or sale order ?

      the latest letter says, (last letter over a year ago) that they noticed we havent made arrangements to set up a suitable payment plan and that their client wants to work with us and thefeore offers the 25% off for us to clear the debt, satisfy the CCJ and start planning a new future. if the CCJ is paid they will remove the charing order from the property and update our credit file, it then just says dont delay offer only valid until 10th March.

        Okay, so no specific threats just an encouragement to get it sorted out. Approx how much is the charging order / judgment for?

            theyve made threats in the past, but this one was yes just get it sorted for your own future type of thing. thanks for your help.
