  • Home Visit By Team Leader While Off Sick

    Hi everyone,

    I'm hoping someone here can help.

    My question is can my Team Leader legally insist on seeing me while I am off sick?

    The work policy is very vague, but it does say in it that it is part of the sickness process, but I don't know where I stand from a legal point of view if I refuse physical with her while off sick. I have kept her updated by telephone on a regular basis, so I don't see the point of meeting up, when I have nothing further to add to what has been discussed on the telephone (and nor has she!)

    Any advice would be gratefully received.

      From what I have read on the Internet, it seems this is part of most sickness process' now, sounds like harassment to me though!

            Yes my Team Leader thinks she is a doctor!!!!!

            Yes, I don't see the point - I have asked my Team Leader for a referral to OH, several times, which so far has been declined! I have been off work three months and I don't want to discuss anything with her until I have spoken to them - the reasons for which I don't wish to discuss on an open forum. She has said that we can meet in a cafe, but, I don't see what the point when it can be discussed on the telephone.

              Does your sickness policy mention meeting up in a cafe? No? I didn't think so.
              So, she isn't simply following the policy/process it seems like she wants to assess you herself and make her own diagnosis.

              First thing to do is limit communicating with her by phone (to nil if possible) .
              This is because if it isn't written down it didn't happen.
              For example, do you really think a record exists of all your requests for an OH referral and her refusals?

              You could send her an email or letter requesting an OH referral and state that you would be prepared to have an in-person meeting (preferably at the workplace) after you have seen them.

                Luckily my Dr is aware of the requests I have made to her about my requests to see OH, so the Dr will have recorded them on my medical record - hopefully. My Dr is appalled by the way this is being handled. I have logged them down too - not that my record of that will be much use!
