tThank you Sharon.. CCA request and Postal Order sent and their latest correspondence dated 20/01/16 acknowledged they received it in August 2015. The court acknowledged they received their copy in July of last year. The following correspondence in August from Bryan Carter/Lowell didn't mention the request at all just asking us to make payments. They also sent Notice of Transfer of Proceedings to court, dated 7/09/15- still not sending us proof or acknowledging our letter at that time.

I have checked my bank statements for that period and no payments made to them. No transactions for £2.50 at all...

Good stuff. Worth giving the court a buzz tmw just to check the claim is stayed ( and hasn't been discontinued or anything)... then we can look at sorting a reply to this letter/witness statement.

Page #50 of exhibit JA2 seems to be the alleged proof of the " mystery " payment?

What of the agreement? Your notes seem to show you did not receive the agreement?

So they claim that the statement of account that they themselves concocted/produced 'evidences' the £2.50 payment. :rolleyes2:

Thank you for giving me your time, it is really appreciated and makes me feel as if I am not alone in this...

I sent Lowell a letter on the 20th August last year requesting a copy of the credit agreement along with any other documentation the CCA requires them to provide. I enclosed a Postal Order of £1 and gave them the 12 working days deadline. I enclosed a copy to Bryan Carter advising they hold off further action till I have the information I requested, I also sent a copy of both letters to the Courts in Northampton requesting they hold of further action until Lowell and I can resolve this.

I received the documents - the agreement and the statements last week 21st January 2016 in the same envelope as the Witness statement. Not happy it has taken them so long and now so close to the deadline.

I will shoot of a letter to Bryan Carter/Lowell requesting proof of that payment but all paperwork needs to be at the courts by a week thursday, 4th March 2016. So due to their delay I won't have that information to hand in, which is the my proof of statute barred..

Any advice on what I need to put in my witness statement for the courts or if it's possible at this late stage to get the court to give me extra time to get this information from Bryan Carter/Lowell..

I have sent photos of July, August and September 2009 copy statements they have sent to me.
The August statement has the disputed £2.50 but I added the others to compare.

I have also drafted a letter today to send by recorded post tomorrow to Lowell requesting proof of the £2.50 payment and advising I will be adding that to my witness statement and disputing it in court. Is that ok?
