Hi I really need some help. I have received a letter from the courts saying that I owe hoist portfolio £3000. It's a long story about where the debt came from, but it was from January 2008. It is not on my credit record and I have not made any payments on the account since Jan 2008. I replied to the courts defending the full amount, saying it was statute barred. I also some to the solicitors representing them and said the same. The solicitors then turned around and said I had made a payment to the account in 2010... Which I never did! What should I do now and what is going to happen?

Do you have the same bank account you had in 2010 and do you have copies of statements from when they said you made a payment ? Worth checking back if possible as sometimes payments are made to a random DCA on the same debt and forgotten about.
Other than that, if you have not paid or acknowledged the debt since Jan 2008 it is likely to be statute barred. The onus is on the claimant to PROVE it is not statute barred.
If they have written to you about this 2010 payment you should respond and ask them by what method the payment was made, how much it was etc.
Anyway, firstly - have you actually got a CCJ against you ?? Is the letter from the court a general form of judgment / order or judgment by default ? Did you get the court papers and enter a defence stating it was statute barred at all ?#staysafestayhome
