    I'd reply and tell them you have asked them for documents in December and they have failed to provide anything and, as they are aware, they are unable to enforce the debt without complying with your formal request under the Consumer Credit Act. So maybe they could get a chivvy on. basically Oh and that any claim they bring will be strongly defended.

        Up to you, you can ring them if you like, but often nicer to have it all in writing, then there's no argument about what's been said and you have a record if you need it later.

            Hello again,

            Update and hopefully some help.

            Applied for CCA in December got a letter asking for 40 days to contact lender.

            Never got the CCA.

            Few letters have come chasing which I ignored waiting for the CCA.

            Letter came today informing me of application for CCJ unless I paid.

            Contacted Mortimer Clarke solicitors who informed me they've had the CCA since March but didn't send it to me. Apologised and told me I have 14 days from today to respond with a payment plan or full payment.

            Is this legit.

            Can the collection process proceed without a CCA being produced. It's been 8 months and nothing and now it seems we are at CCJ point without so much of a sniff of a CCA??

            Any advice would be really helpful.
