PLease Help!!! Mortimer Clarke and Cabot financial!!!!!

  • PLease Help!!! Mortimer Clarke and Cabot financial!!!!!

    In July of this year I had a letter from Cabot who had found the credit agreement-it had taken them a year.
    I have attached a copy which is pretty illegible and also a paper they sent with it which was also marked illegible.
    I didn't respond and heard nothing more until today-six months later-when I received a letter form Mortimer Clarke.
    They have said the debt is payable in full and want me to fill in an income and expenditure form.
    They have also enclosed a offer to cut the debt in half to just over £3000 if I enter into a Tomlin agreement.
    I don't know why Mortimer Clarke took six months to contact me after the letter in July..it seems odd.
    My question is what should I do next?
    Do I have a leg to stand on? IS the illegibility of the agreement a reason to question them ?
    Should I enter into a Tomlin agreement? I have attached a copy of the illegible bit and also their paper marked illegible.
    All and any advice gratefully received!!

        A document produce via CCA request must be clearly legible in All parts
        otherwise it is not compliant.

          The document I got after a cca request was very poor but as my signature could be seen he accepter it

              Yes the judge accepted it BUT I think he had made his mind up before I had even walked in

              personaly I think it depends on what mood the judge is in as i belive the first judge wouldn't have accepted it

                    An agreement must be easily legible in ALL parts you document is certainly not.
                    It may be worth writing to Mortimer Clarke telling them that the alleged agreement
                    fails to meet the requirements of CCA 1974 as it is illegible.
