Template for claiming credit crad charges over 6 years

Hi all,

Bear with me as I learn about these things. I have received a SAR from capital one and noticed unfair charges in 2003 and 2006. i have read the various steps for stating the use of the limitations act and therefore would like to send the first letter. I cannot seem to access the template that was referenced due to my user privilages I think.

Can you someone post a copy of the template letter and actually let me know me know exactly how far I can go back ? I assume as I got the SAR a couple of weeks ago, then that was the first time I was aware besides the statement at the time.

You would struggle to reclaim any charges from 2003 and 2006 but it wouldn't hurt to write to them to complain. In 2006 charges were 'limited' to £12 and since then a number of people did only manage to claim the difference between the ''fair'' charge and the ''unfair'' charge. Are there lots of charges?

The templates for the reclaiming of credit card charges have been removed as it passed 6 years since they were reduced, there are arguments on limitations, much as there are in PPI. It really depends on the value of the claim and if any debt is still owing on the account ? eg. it could be used as part of the negotiation process or in a defence.

There are not many charges but I am just looking to reduce the debt by anything I can. I did get PPI knocked off the balance from years ago. The charges for 2003 and 2006 are all £20 on my SAR report so must have just been before charges were standardised. I did look at other threads and even recent ones from last year where some of our members succeeded. They used the section 32 limitations argument on a mistake. I tried to click on the link for the template but it did not allow me.
