  • New here and need help

    Hi All,

I am new to this but hope some of you can help me, will try and explain in the best way I can -

I have an account with Littlewoods in Nov 13 I ordered some items on behalf of someone else that should have been paid off over 12 months, however this lady only ever made one payment and as I cant afford it to pay it myself the debt is now sitting on my account. I have not spoken to this lady since Oct 14 when she threatened me, I advised Littlewoods of the situation and they advised if I involved the police due to the threats then they would the remove the balance from my account and deal with the lady direct, I involved the police and then Littlewoods backtracked saying the account is in my name so it is down to me to pay the account and then take the women to court to reclaim the money. Due to the threatening nature of the lady I am not willing to do this as it would cause me more trouble, I involved the Financial Ombudsman due to Littlewoods not responding to a different complaint I had put it and off the back of this they sent the lady a letter asking her to admit liability for the goods and balance so that they could deal with her direct, of course the lady ignored this letter and so Littlewoods have reverted back to me constantly ringing me (sometimes 10 times a day!), since March I have ignored all phone calls.

Where do I stand with this? So far I have refused to pay the balance £700, however I don't want Littlewoods to take me to court, is there anything else I can do?

    Hi welcome to LB,
This has been and probably continue to be a problem with allowing others to order from a catalogue account in your name, unfortunately you are liable for the debt unless you have some written agreement between you as to number and frequency of payment and /or who the items were intended for i.e. were the goods delivered directly to the person and signed for.

      Hello,

Unfortunately no written agreement I have however kept all the messages where the lady was saying she refused to deal with me and would only pay Littlewoods direct but I haven't had any contact with her since Oct 14 when she threatened me, one of the items was delivered to her address and the other to her parents address both signed for.

Your best bet really would be the court route. If Littlewoods sue you, then join in this lady as a P20 defendant for an indemnity.

If you wish to sue, then let us know.
