    hi i have a morgage with boi only small £98 a month because i got ill i got in arrears and in last 3 years they have charged me £2500 in fees is that legal

    Hi Welcome,

    My guess is these fees are laid out in the terms and conditions of the mortgage agreement you signed, you will need to check them.

      If you can post up a copy of your T&Cs I'm sure someone will check them over for you x

        are they actually applying for a repossession order ? through the courts ?

        you need to consider making an ' official offer' before this goes too far.

            it would seem that this has already been through the court process and they have already obtained a full repossession order

            did you do anything at all to try and stop this from happening ?

              You will need to apply to the court to suspend the possession order, unless you have already tried this. Well, you can try again but we need more info.

              Are you able to pay anything each month ? Have you discussed it at all with the lender?

                What were the conditions of the repo order, with leave to apply for a stay of the repo, or no application without leave of the court.

                    Firstly, a number of posters on here have had to deal with similar curcumstances in the past, so your not alone, If you really want some proper advise , you need to add some details to the thread so you can get the advise you need

                    1. Total arrears
                    2. Total mortgagee
                    3. Dates of notice

                    prior court action on the notice for possession/eviction

                    4. any other debts tied to the property
                    5. Who is mortgagee co agent ?


                    and any more detail you can add

                      £1400 arrears £50.000 morgage been court few times using nt244 and usally make a deal and pay some .but after seeing the fees they have charged me £1000s i wanted to make it known to judge .

                        Ok, so the arrears aren't that bad, will need the other details, plus current value of property (estimate will do )

                        Did they have a suspended possession order ( from what date ) , have you breached it, if so , by how much.

                        Is boi Bank of ireland ? who are acting as the agents for BOI

                        You need to deal with this quick/sharpish. if you can post up your T&C from morgagee, and any court orders ( redact your personal detail out of it )

                        NEED FULL DETAILS TO ADVISE FURTHER

                              Thats to understand what asset you have, you can use this against them depending on the curcs.

                              and when did they get possession order ( date )

                              did you appeal the possession order ( give as much detail as possible )
                              Did you appeal the eviction order ( again, as much detail as possible )
