  • Hi just joined.. 👋 looking for advice regarding marlin

    I have received to letters from marlin regarding a Crédit card debt they acquired from HSBC which I was paying off quite happily till marlin got involved and are pushing for me to clear it and making threats to recover in other ways ?.. Advice please anyone x

      can you give us as much info as you can please (easier to advise if we know the circumstances)
      maybe post up redacted copies of letters you have received etc...

            Further to our previous correspondence we do not appear to have a repayment plan agreed to address the outstanding debt.

            It is extremely important that we. Speak with you to discuss your financial situation. With this in mind,please contact on 03331239999 where our trained account managers are ready yo take your call and agree to an affordable repayment plan that will suit your current circumstances.
            Our office opening hours are Monday to Friday 8:00pm till 8:00pm Saturday 9 till 1pm

              How many letters have you had from marlin so far?
              Have you received a notice of assignment?
              Have you been paying what you agreed with HSBC since marlin got involved?
              Did HSBC agree to your repayment plan to begin with?

              Keep all contact in writing, do not phone marlin!! Send letters recorded/signed for (costs less than £2) and save all emails

                You need notice of assignment if they have bought the debt. Have you received one?
                Do not phone them if you have to deal with them then letter only.

                  I have received 2 so far I was paying hsbc on as I bank with them and my wages are paid in to hsbc... I had a break down couple of years ago and lost touch with my what we're quite organised finances and also lost a small part of my life and have forgotten any conversations and correspondence I may or may not have had from them very hard to explain unless experienced this break down was bought on due to my baby son being very ill, which I've only just learnt to deal will and and start to live again... I did once get behind on a payment and they sent a debt collector round for pennies... But continued to pay as usual... So do not understand why I have received this now seeing
                  as it was 2011 I had the issue with them.. The payment agreement was with HSBC Originally..

                    First of all, they can send as many collectors as they want, you are under no obligation to speak to them or give them the time of day. They ere NOT bailiffs and have no right to visit you in your home without making an appointment. There's a letter you can send to stop that.

                    Marlin are debt purchasers as opposed to collectors so they would have bought the account from HSBC. This means HSBC has no reason to get payments from you for a debt they no longer own.

                    The letter Marlin have sent you is a standard template and nothing to be concerned about. :thumb:

                    If you wish to continue making the payments you agreed with HSBC you'll have to change them to Marlin who are the new account owners. You could also send Marlin a CCA request and see what they come up with, especially if this was an old credit card taken out before April 2007

                          Good morning iam sorry to have to ask again but I feel rather sick and worried I have received yet another letter from marlin stating they will be instructing a solicitor to review my account to see whether there client should take me to county court or a field agent will be instructed to visit my home to collect payment or a alternative debt collection agency will be instructed if I do not contacted them in the next 7 days with an agreed payment plan... I really can not afford any person or persons turning up I have an autistic son and this will most certainly upset him.. Do you have any further advice for me please I am emailing them with a letter requesting evidence of a credit agreement.

                            It is very unlikely they will send someone to your home, however best way to prevent that happening is to engage with them. It doesn't sound like the letter is a letter before action, but yes sending a formal CCA request is a good idea. You should follow the email you have sent up with a letter, enclosing a £1 cheque or postal order, so the request is binding.                             I read your previous posts and am not quite sure if you are still paying HSBC for this debt or if that was an arranged payment plan with HSBC or not?

                              Thank you for your advice I have requested a copy by email and also will be sending a postal order for the original full credit agreement today... My arrangements were with HSBC who my account is with and can not understand why this has happened always paid direct debt each month only thing I can think is a while back I tried to set up my direct debit and lost in translation as over seas call centre he was telling me that my account was getting behind by £10 a month which I thought we had corrected by moving payment dates... I just don't understand why there could be any other reason for them to instruct marlin. So if I don't receive an credit agreement where do I stand?
