If you look at the example defence I linked, which is fairly generic, you'll see there's no need for you to provide dates, just to state that there's been no payment or acknowledgment in 6 years. The onus would then be on THEM to PROVE that you have, in fact, made any payments in the past 6 years and provide statements showing the dates, if no payments were made, they'll have to accept your defence. :grin:

how terrible that they were real court papers, they just come in normal post, I really believed that the so called court stamp looked like a thin black stamp, so I haven't helped myself.......

I have downloaded the N244 , thanks flaming parrot, I aslo went into my bank this morning, they can not go back that far, so the advised me to use there phone and call banking, which I did, they will try to look, I'm sorry to ask but I may need guidance to fill these out, I did call the court and asked for details of CCJ so I'm waiting for them to come, so do I need to wait for the paperwork from court about CCJ? I proberly would, then post it all off, also do I enclose the money in postal orders? Thanks

I have downloaded how to fill out N244, a step by step guide, so I've started, defendants name, which is me.... Oh I feel so in control xxx thanks guys xxx
in evidence set out below, I have put, no payments or acknowledge ment in the 6 years, I also read, what level of judge District ... Flaming parrot and righty , thanks I got information from you both , so far so good???! What do you all think????
forgot to say, part were its asks , what are you asking court to make and why, I have put TB" d for CCJ placed on my credit report

Thanks amethyst, maybe I need to wait for details of the CCJ to come, I was told on phone that Cabot now have my details, so they would be claimant, the draft order, I don't believe that would concern me? So I shall no,all I need is , how do you want this dealing dealt with? Hearing or no hearing? I would be grateful, also give details of any fixed trail or date, so I assume that would be the date they got the CCJ. Thanks again , and thanks for the link

Also I am worried, the letters I got did say I needed to Give them information on finances, which I did not, also they wanted me to make payments, which I did not, they said they would take it to court, but over the years... On and off different company's have brought this and have sent letters, Al, which I have never acknowledged, so when I got a credit report alert and see the CCJ , I always believed if it went to court for that ... Surely the court or someone would inform me????
i will call them and ask them to set aside the judgement, and take it from there.

Most applications are dealt with at a hearing.:juge:

Creditors often send income and expenditure forms, however, without a court order you are under no obligation to provide those details, unless you want to so don't worry about them.

You should have received a claim through the post which you would have had the opportunity to defend, as you were denied that opportunity, you will be applying to have the judgment set aside. :thumb:

i will call them and ask them to set aside the judgement, and take it from there.

You can ask them whether the would consent to a set aside, however, if they do not, you will have to proceed with your application.

You should have a document called 'Draft order', that should give you an idea. :typing:

Phoned Cabot, they said they not dealing with it, it's gone to merlin, who are a litigation department, they put me through , he said they vp can touch the case, it's with mortamar Clarke solisitor, so now after them running me round, I'm calling them,they have just said ,... After I told them that I was given legal advise, they will put it on hold for 14 days they will look into it, to see if they can do that??? I don't understand???

And why did Cabot pass me to merlin, they say they can't touch the case, they say it's with mortamar Clarke, they asked why I think it's should be set aside, I said I was given no notice, he said you were sent a letter saying you can make payments, and give details of money, I said, I never acknowledged or paid any money, it's been over 6 years, he said you had the required 30 days you took no action, but the only option was pay, or make payments, now they say they are going to look into it? Do you think that's true? They kept putting me on hold, each department saying they needed to speak to the manager
