  • Rossendales again - sorry

    Hello everyone,

My partner received a liability order from the CSA on 20/01/10 for just over £2000, he phoned the CSA and arranged a payment plan of £90 a month over the next two years. A standing order was put in place and he finished paying in May 2012, before he stopped the S/O he checked back through his payments to make sure the balance was clear, it ended up he had overpaid by £27.

He has now received letters from Rossendales stating that he has to pay them £250 or £350, depending on which letter you read from them, against the liability order dated 20/01/10 and on Saturday a notice of distress was put in the letterbox with his car stated as being imponded by them and it will be sold in 5 days (it is actually parked behind high metal gates which they cannot get through without a key).

As his original debt to the CSA was paid up by May 2012 he emailed Rossendales to state this fact but they have still issued the notice of distress. He doesn't want to ring the CSA as he fears they may start looking at his file and say that he owes money running into the thousands (cash in hand was given to the mother of his child weekly until she was 18).

Where does he go from here does he pay Rossendales to get them off his back or chance ringing the CSA and his file being re-opened?

Any advice would be greatly received.

    Thank you,
    Pallmall

    Re: Rossendales again - sorry

If the motor car was inaccessible - even if it was visible - then the levy will be just as invalid as a levy on household goods would be by a bailiff peering through a window.

He does need to know what liability order was passed to Rossendales and why a distress warrant was issued without his being informed of the alleged need for more money. It looks as if the (largely useless) Child Suppression Agency has cocked things up...

What is on the liability order from Rossendales i see its dated 2010 on the same date as the £2000 which has been paid is it for fees or the CSA debt this would enable those on here who can advise (not me i admit) to help
      All seems strange to me?

Were Rossendales involved from the outset with this matter? If not, they can go swivel. As CC has said, it sounds like the CSA has cocked-up - again - and need to sort this out. If they don't, be prepared to escalate this through to the Parliamentary Ombudsman. It may kill Rossendales pig, but it may also give the CSA a well-deserved kick up the backside.

Thank you all for your prompt responses.

Wales01man - The notice of distress is dated 09/03/13 but is quoting the liability order of 20/01/10 and for which they are chasing a debt, but as far as we are concerned this should be a closed matter now.

So sorry to back track, would you advise a call to the CSA, even though it may make them review his file/case. If it helps his daughter is now 21 so how far can the CSA go back on old cases?

Seems calling the CSA might answer the questions im sure they would have had a hand in the liability order only they know if debt was paid

I doubt that the Clueless and Shambolic Agency really knows anything.
