well in the last month i have had 2 out of 2 set aside

debtline etc are as usual talking out their backsides

how was the demand served

personal service or post and when did you get it

Who is Ask Nigel? The problem about choosing a lawyer you've never met, etc... is that, even if he/she are registered, if they screw up it will be YOU who will end up carrying the can. Anyway, there is enough combined knowledge on this site to take care of the biggest bullies, and if your case was hopeless you would have been told that with an advice on how to proceed. So have hope

Hi again, so my financial advisor friend thinks it's ridiculous to try and have this set aside. I spoke to a solicitor today who says we can based on no signed contract or letter of assignment and that the fa is acting foolhardy by trying to negotiate. My head is battered with this! We have made two offers so far, first refused, not yet heard about the second. Does this negate any possibility of having the demand set aside? I have until Friday The solicitor says he'll do it on a no win basis but I guess I can do it myself?

the question is

do you acknowledge 1st cretins right to issue the demand
do you agre with the amount they are claiming
does the debt have ppi or penalty charges attached
have you received a notice of assignment
do they have an agreement,default notice

i can go on and on any any of the reasons mentioned is enough to have the SD set aside

making an offer is ill advised as it can be seen as acknowledge the debt,

was it done by letter or on the phone??

but will make no difference on the SD unless they accept the offer and withdraw it

even if its withdrawn, allways get it set aside to stop them doing it again

Paula. Take a deep breathe and read carefully again what miliitant says. Even if he's wrong (which I dont think he is and nor does the solicitor you spoke to) you lose nothing by trying to have the SD set aside. Miliitant has given a lot of people a lot of good advice and others have chipped in to help. If I was you (and I know I'm not) I would stick here with your anonymous support network.

Thankyou, I've read through the threads and am inspired to sort out the forms tomorrow. As you say qckate I've nothing to lose. I will keep updating cos I'm sure my experience will be relative to others. Horrible experience, your support is much appreciated

The offer was made by post and does acknowledge the debt unfortunately. It was rejected. The second letter did ask about if penalty charges had been removed, haven't heard back yet.
