  • Connaught and 1st Direct Statutory Demand

    Hi everyone. I'm feeling completely up to my neck in it and would appreciate any help, ideas, encouragement!!

    On Monday I will be receiving a stat demand from Connaughts on behalf of 1st Direct. I won't answer the door but it will be put through the letterbox which I know they can do. The amount owed is 4,200. I also have another amount with 1st Direct for £5,000. This has not yet been issued as a sd. I phoned both companies after finally opening all my demands which stupidly I'd hoped would go away. I last made payments 4 years ago. I phoned 1st Direct after advice from a financial advisor. I didn't make any offer but told them that I was dealing with my debts and would make an offer after drawing up a financial plan. I somehow ended up being drawn into telling them about the worth of my property. Our home is mortgage free and is the only asset we have, jointly owned by myself and partner. We have two teenage children, i am the sole earner on a public service wage, we juggle monthly bills and certainly don't live beyond our means anymore. I am desperate to come to an agreement without putting our home at risk, but everything I read about these companies suggests they will go the distance.

    I know that they don't have to accept an offer but does anyone know what the liklihood is that they will I don't have the kind of money they are after!

    conaughts are 1st credit so the debt must have been assigned to them

    what previous correspondants have you had from 1st cretins

        Hi

        Thanks for the response. Just letters asking me to make them an offer. I've been advised by a lady at Debtline to get a financial advisor to find me a loan as they will probably come after our home!!

          please read that thread i have posted

          strict protocols have to be followed in issuing an statutory demand, break any of them and you can have it set aside. you will have 18 days to put in the set aside application from receipt if this happens

          is another loan the best answer and the lady from debt line should be ashamed of herself

            I doubt I have reason to have it set aside. Apparently they are now very careful after 2009 and only go after people they are sure of. Our home is all we have but there is no mortgage, they know that and I'd guess it makes me a worthwhile target. I was shocked she advised a loan and it kinda confirms they'll come after bankruptsy and our home. Am so worried!!

              I doubt I have reason to have it set aside. Apparently they are now very careful after 2009 and only go after people they are sure of.                 this is what i would do in your position if you receive the statutory demand

                apply to have it set aside, if you fail then apply for a loan

                i have had quite a few of these set aside myself, please look at that other thread


                have you had a letter of assignment for example by recorded /special delivery from 1st cretins saying they now own the debt

                my score is three out of three with these muppetts

                  Really?! What grounds did you use? I haven't a letter of assignment. I did speak to them saying that I would make a payment offer. Looking at some of these threads they don't seem likely to agree to anything less than substantial amounts which we just don't have. And I don't see how we'd get a loan with poor credit ratings. Do you think this is hopeless? I'm encouraged by your victories tho. Cheers

                    is the amount claimed full of penalty or collection charges, or ppi

                    thats another ground to set aside

                    you only have to dispute the debt to invalidate the SD

                    do they have an agreement, default and termination notice

                    have they given you a full statement of account and how they got that figure

                    i can go on and on

                    case law dictates that the insolvency service should not be used as a method for debt collection and circumventing the county court, thats another reason to set aside

                      Thanks there's some really useful info here. Why don't Debtline tell us this in the first instance I wonder!! I'll be receiving the stat demand on Monday so I'll see what's what then. I will certainly try and have it set aside. Neither debtline nor a financial adviser suggested having it set aside. Ta for this

                        as soon as you receive the demand update your thread and i will advise on how to set aside, but please read this thread to get an idea

                              Hi sorry for not updating.I have had so much conflicting advice about this and have been completely up the wall!! Debtline and financial advisor have told me I have nogrounds for having stat demand set aside and that I will be delaying the inevitable process. so have been offeeing them payments based on what I can afford. They have of course refused. I have the stat demand now. There is someone advertising as Nigel on Internet who says he can have stat demands set aside on a no win no fee basis. If he has it set aside Connaughts pay?? Does this make sense? Any advice greatly received!!
