    Hi everyone, this is the first time I have used a forum so I hope Im doing this right !

    We have 2 secured loans with Welconme finance both taken out in 2006 and 2008, the reson we have two is we own 2 properties.

    The largest one was for £29,000 in 2006 which as July this year with no missed payments whatsoever at had a balance of £30,800 ??? we had a couple of late payments which we called in advance and adviced would be a couple of days late as we are both self employed and waiting for income to reach us. Unfortunately the property on which it was secured was issued with a possession ordfer from the first mortgage lender as we were paying welcome over them due to their constant agressive and threating calls, which now as obviously the wrong thing to do. we dealt with a branch manager at welcome and offered a reducerd full and final settlement, this was never replied to instead our account was defaulted. We then received a call from nottingham to say they would offer us the chance to repay the loan with no interest and charges but we had to over pay on out original payment to reduce the balance down. i asked about the full and final settlement and they said they had not seen that and would not accept it anyway ??

    They are asking for £310 per month which we really cant afford and where is all the money gone that we have paid since 2006 ???

    Our second loan is secured on our home for £18k , this was £16k when we took it out in 2008 and again no arrears on this one , and we have actually been overpaying this one since march by £50 per month as we were told it would bring the balance down quicker and reduce the term of the loan. I called them this week to advise the payment would be a couple of days late as i was waiting for commission to be paid to me and they said it was not acceptable as I was 1 month in arrears?? i questioned this as the account has not been in arrears and i have been over paying and they said that my payment date was 15th and I have been paying on the 30th for the past 2 years , (as I arranged with them and they know) so therefore every month my account goes into arrears for 15 days, but they said they let it go as I always pay ! so am I being charged for this too ??

    Please help if welcome are bust are these loans actually enforceable on my properties ???

    Hi Lilly I have a secured loan with these muppets taken out in 2008 for 16,000. We have had arrears built up however they have now reduced our monthly payments considerably and I am now paying 0% for the rest of the duration of the loan. I strongly believe they make up rules as they go along!!

    The pattern that has formed with me and others on this site are, they:-

    Blame things/incorrect data on 'technical problems'
    No credit agreement or wrongly executed
    Despite paying off £000's you still end up owing more than original balance

    I am certain others on this site would be able to add more extensively to this list.

    First port of call is to DSAR (Data Subject Access Request) them. That will give you a much clearer picture of what is going on. There are template letters on this site which will tell you how to format your letter. There is a charge of £10 for this, however it is well worth it.

    Good luck and PLEASE don't let them bully you - they smell fear and breed on it!!

      Totally agree with Ruby.
      If you do an SDAR or CCA just make damm sure you tell them that what the postal order is for.
      They have paid a CCA from me onto a disputed account.
      When I did an SDAR they returned documents relating to an old address and nothing that matched our currant address or alleged account number, they have, in writing admitted it is unenforeable.
      CAB have been very helpful as has this site.

        Wow thank you for your advice I will get the letter off requesting the SDAR today and hope for the best, should i continue paying them ?

          Pay them what you can comfortably afford to in the meantime. They legally have 40 days to supply all the information due under the DSAR. After that period of time , once you have had a chance to examine the data they sent please get back in touch and we will do what ever we can to help.

          Please, please in the meantime DO NOT let them get under your skin and rattle you - they will have had specialist training to try and squeeze what ever they can out of you. The time has come for you to get your own back and make THEM squirm!

            Right or wrong not paid them anything for over three years!Had letters over the last year from someome called Incasso sent them the fee for CCA and welcome paid it into the alleged account. Nothing since March from any one. Now trying for the PPI they added to it! They are known to be devious and if you look under Cattles on this site you will see the amount of problems people have had.Good luck!

              The difference DT is that your loan seems to have been secured on your old address - if they put down your old address on their info? Is it not rather risky if they have your up to date address and you are still living there AND this loan is secured (supposedly) on your home?

                Well not sure on that one, they actually admitted it was un-enforeable and despite all the usual threats, as yet nothing has happened, but saved everything and CAB have been fantastic.

                  Lucky you, in a way DT! I may also take a trip to CAB. On my to-do list is DSAR Welcome, however I have seen my credit agreement and it is signed and has our correct address (unfortunately lol).

                    Would not say " lucky" exactly.
                    CAB have said it is for lots of reasons unenforceable and I am fully aware that the alleged debt still "exists" until if and when Welcome come up with a proper document for this address and alleged debt number.
                    What I am unsure about is the time limit when it becomes statute barred. We moved over eight years ago and it was not until I did the SDAR that I noticed that the documents returned were for our old address and had a different account number!
                    It will be four years next year when I stopped paying them

                      I take it Wf/cattles is not named on the land registry on your current property? If thats the case then in two years time they can sing for it....

                      Thats my own opinion anyway.

                        I did get in touch, verbally, with the Land Registry and was told I would have to pay to see the entry but the person I spoke to did say that there was mention of "Progressive Finance" who I found out (on LB)are or were another part of the same group

                          I have also got a copy of my title register from land registry and there is no charge for the £30k loan but there is a unilateral notice from 2004 for progressive Finance.

                          is this enforceable, the land reg said i can fill out a form and request it be removed and if they dont hear back from Progressive within 15 days then it rules in my favour and will be removed !

                              Me again been through the SDAR from Welcome again and among them is a duplicated Land Registry Documents.
                              Again daes do not match dates n the alleged loan documents (2000) Will try and scan them in later.
                              Welcome,Progressive Finance,Cattles etc ARE NOT mentioned at all
