Thats true, but its clear as the bank have not refunded the charges that were the result of the ID theft, then the likelyhood of the issue being resolved fully is minimal if at all.

Also, it could be said if it was fully resolved and the OP reasonable assumed that the charges were refunded (which is perfectly reasonable to assume since the cause of the charges was the ID theft and the transaction that resulted from the ID theft) that the OP was well within their rights to seek compensation for the financial detriment caused by the charges not being refunded when the ID theft issue was resolved/dealt with originally - which most banks would do, and any reasonable person would assume/expect them to have been refunded.

As he stated the ID theft part was resolved, the assumption I made was that the bank refunded those that formed part of the ID theft, so the question remains, then, was that the case or not?

Or are we talking about new charges unrelated to the ID theft?

Yeah i know where you coming from Leclerc - My own assumption is that the charges occured as a result of unauthorised transaction caused by the ID theft as i can not see why the ID theft would have been mentioned otherwise.

So if my assumption is wrong, then you would be correct in your previous post (#15) :tinysmile_grin_t:

If you legally cannot fine or impose charges on them then they legally cannot do so to you as well - the banks are in so much debt to the public they need to be careful how they are treating the public in the UK

.....outside of the contract which is what the OP is suggesting so that means the former arguments for bank charges as penalties in law would apply for the bank to refute this since it becomes a unilateral term rather than an agreement to the term which is done by continuing to use the existing account.

Hi Felix - this is probably teaching Gran to suck eggs - but on the i.d. theft side of things, have you subscribed to a CRA membership eg with Equifax? You can check any CIFA searches etc. Before i get shot in down in flames about promoting CRAs, while I positively hate them when it comes to most matters, one of their better aspects is i.d theft prevention.
