    hi im new here and im desperately seeking some advice or a point in the right direction of some1 who can help my father passed away over a year ago and his will stated everything was to be split 50/50 between me and my brother the will went thru probate etc no problems and his estate has been sold and the solicitor has finalized his affairs i recieved a few interim payments from his bank accounts ets from the solicitor me and my brother both had the same the problem i have is my brother wants me to give him 20 000 from my half because he says some possessions of dads were missing which i no nothing of i instructed him we should go to the police and report the missing items but he wudnt hear of it as i refused to give him the 20 000 he has hit me and my husband threatened me accused me of theft obtained my daughters medical records etc this is a living nightmare as we both have to sign for the money held by solicitor he wont sign so the money is with the solicitor and neither of us can have this money until we both sign for it . im scared of my brother and the threats and abuse is worsening by the day bcos i wont agree to give him the 20 000 from my share plz tell me what i can do or where i can go for help ps we both have ther same solicitor and she is a personal friend of my brothers any help would be so appreciated

    Contact the police about the abusive behaviour and get yourself a half hour free appt with another solicitor to find out your rights. If the soliciotrs you are using is not acting in your best interests due to her relationship with your brother then you need to formally complain and bring it up with the LCS.

    Is you brother in financial trouble at all ?

    How has your brother obtained your daughters medical records and to what end?

    Was any inventory of your fathers property taken before probate ?

      As Ame says go to the police and request that they give you a panic button and make sure you stress to them how scared you are that your brother is getting increasingly violent.

      I'd also investigate the possibility of getting an injunction against him to stop him approaching you and your family.

        Phone the police NOW. You and your family need to be protected. You may be scared of your brother, but the longer you leave it, the worse it will get.

          hi everyone thanks so much for the replies in answer to your questions i dont think hes in any financial trouble and as far as the medical records his wife works in a hospital that my daughter was having cancer treatment i assume his wife made enquiries into my daughters condition as he took great delight in mocking her to me i contacted the hospital and they palmed me off with he couldnt find any information but i no have him on dictaphone admitting this and threatening me and abusive behaviour also there was no inventory taken ever he was an antiques collector and his house was full every room in junk etc and any of his belongings that were sold was split 50/50 . im going to call the police as again this afternoon the threats havent stopped hes a bully and wont back down until he gets this extra 20 000 and in the mean time my half of my dads will that im legally entitled to is just sitting in an office thank you all for the replies they have been a great help

            sorry i forgot to say above does any1 have any knowledge or ideas regarding the solicitor not releasing my half of the money surely she cant hold the money indefinately bcos my brother is being greedy ? thanks

              Cardiff27, go to a different solicitor and tell them everything and remember to tell them the the original solicitor is a personal friend of your brothers. I think you'll find that whats going on between you're brother and the solicitor is highly irregular and the new solicitor will point you in the right direction.

              Have you been to the police and reported you're brother yet ?

                  Ditto, If the solicitor is advising your brother then i would run away from then as fast as.
                  Ypur brother is saying things have been stolen, but everything was split 50/50 anyway.
                  ~Never has PPI refunds been owed to so many...by so few~
