  • HELP!!

    Hello,
I've found myself in such a mess.

NatWest their agents Shoosmiths are taking me to court tomorrow! My overdraft debt was £1900. They now want over £4000... They have tried to get a charge on my property in January, I ignored the letter from the court, I haven't been able to cope since my partner died last April. Is it too late for me to fight this unfair amount? What do I do tomorrow?

    Re: HELP!!

Hi there, welcome to the site ((((((((((((((((((((hug))))))))))))))))))))))

Is the court hearing for the final charging order to be applied? Are you actually in court or are they issuing papers tomorrow?

Firstly you want to argue to get installments set at an amount you can afford, don't be bullied, be upfront with the judge explain about your partner and the trouble you have had coping. Say how much the debt is you believe you owe and ask shoosmiths to justify the increase. I

Probably too late to change how anything will go tomorrow but come back here after wards and we can have a better look at the case and if need be go back to court for redetermination and fight any unfair charges etc added to the account.

If its not actually in court tmw then if you can post up a bit mroe info where things stand, what the debt breakdown is, any particulars of claim they have entered etc, we can try give you some guidance and support where to go from here.
