  • county court claim form

I am writing to seek your urgent advice regarding a County Court claim I have recently received from Private Parking Solutions (London) Ltd, issued through the Civil National Business Centre.

I would like to highlight the following points:
    1. I do not recall parking at the stated location (Middlesex Business Centre, Southall UB2 4AB), and I have no memory of seeing any signage or entering into any parking agreement.
    2. I was not aware of any prior correspondence regarding this matter (no clear recollection of receiving a PCN or follow-up letters before this claim).
    3. The claim contains an error in my firstname. It is addressed to “Mrs ----ersa" whereas my correct name is “Mrs ----era.” I am concerned about the accuracy and validity of the claimant’s records.
    4. The amount claimed (£269.51) appears to include additional costs which may not be justified or enforceable.

Given the above, I would appreciate your guidance on the following:
    • The best course of action in responding to this claim
    • Whether we should file an Acknowledgment of Service and proceed with a full defence
    • The strength of a defence based on lack of contract, unclear signage, and incorrect identification
    • Whether the incorrect naming has any legal impact on the validity of the claim

Please let me know if you require any further information.

As the response deadline is approaching, I would be grateful for your prompt advice.

    Kind regards,

First acknowledge the claim, but do not enter a defence

Send Parking solutions a Subject Access Requesthttps://legalbeagles.org/library/gui...ccess-request/
          Send Gladstones a CPR31.14 letter.https://legalbeagles.org/library/gui...-of-documents/

Those templates need amending for your situation
Do not identify the driver in those letters

In your first post you state: i) " I do not recall parking at the stated location ...... and I have no memory of seeing any signage ...." and then suggest as a possible defence "unclear signage," If you didn't see the signs why do you think they were unclear?
ii)"no clear recollection of receiving a PCN or follow-up letters" suggests you may have a vague recollection . If you can locate the original PCN it would be good if you could post up a redacted copy (leave in all dates and times).

The typo in your name is of no importance .. it is simply a minor typographical error

Your defence will need to be filed by 13th April, so give me a nudge either when you receive a response to your letters or around 6th April if no replies received.
In the meantime if possible get photos of the signage at the entrance and within the car park. The photos should be fully legible, and that includes even the small writing!
