Defaults cleared six months ago from my credit record .

  • Defaults cleared six months ago from my credit record .

    I had six defaults with links and they all have been cleared from my record last year as it past its six years period and I have been paying them £1 each until recently I have stopped the payment I was wondering if they still can take me to court . Many thanks .

    Welcome to LB

    Unfortunately, yes they could, as to whether they take you to Court or not, is not reliant on whether there are Defaults on your credit file. It will depend on the debt amount and whether they can provide the Court with the correct documentation to enforce the debt.

    You can request the documentation to check whether it is compliant or not, if it's not compliant, then it 'unenforceable' through the Courts. -

      Thank you for your response to my earlier inquiry. I wanted to provide additional details regarding my situation.

      My credit cards date back to as early as 2001 to 2004, or possibly earlier. A few years ago, I submitted a Right to Information request along with the statutory £1 fee. However, after the deadline for their response had passed, I received what appeared to be incomplete or fabricated copies rather than true, detailed agreements.

      At the time, I chose to continue making token payments of £1 per month toward these accounts. However, I ceased these payments entirely two months ago.

      Since you have suggested revisiting the matter, do you recommend that I issue another Right to Information request for these accounts? Your guidance on the appropriate next steps would be greatly appreciated.

          I have send link financial the letter with one pound postal order and they replied back today and send the postal order back and mentioned under the section 77-79 we no longer require a fee .if you have quires or question please do nor hesitate to contact a member of our team and we will be happy to assist you further .and that s it , what do you think .

            They've returned the fee. So give them a couple of weeks.
            Normally they have to go back to the original creditor for the agreements etc.
