Hi - received several letters from Lowell about old debts from 2018/19 - these were being handled by step change originally for four years but due to family circumstances and mental illness. I was unable to maintain the hundreds of pounds per month for the DMP. I have contacted step change to ask what date they received the last payment (this would have been sent to all the creditors at the time) and they replied that the last payment received from myself and partner was in February 2019. The last time I had any contact re these debts was from Lowell in January of 2020 in which I questioned each supposed debt amount, they never replied. My question is - if the creditors only received payment in 2018/19 and they did not take recovery or court action and Lowell have now bought these, does the statute bar come into effect from the original creditors payment and lack of action? I suspect that Lowell have noticed these now after all this time and will pursue through the courts before any statute barred limitations can be applied. What should be my next step ? Should I contact Lowell and ask for every account details / amounts paid etc and dates (along with proof) when they write next (which I'm sure they will do again being the vultures that they are) any advice appreciated.

Firstly, try not to worry.
When were the accounts opened?
Have you sent a CCA request? (make sure you get Proof of Postage)
If they can't provide the documentation, the agreements maybe 'unenforceable'.

Hi and thanks for the reply and advice, much appreciated. The original accounts will have been opened 2015 / 16 We started DMP with step change around that time (Don't have all the details now) I haven't made a CCA request as yet. I will on my next letter from Lowell though!Comment
