      Hi there ive now had a response from Link that makes no sense to me and im unsure how to proceed your help is appreciated
      It says after reviewing the account they confirm its not statue barred as legal action was taken against Mr Acott (unsure who this is) on the 14th june 2011 so the account can never be statue barred so to set up an affordable payment plan
      How do i proceed with this please

        There letter also states that there policy is to cease contact with customers if no acknowledgement of the debt and no payment has been made in the limitation period i have never paid anything or acknowledged it in any way and have no idea who mr Acott is

          It does sound like they are making stuff up.

          You could send a SAR request to link, see if they correct the Mr. Acott or stick with it. Make sure you get Proof of Postage. You really want to find out what is what.

          In any case you can / should lodge a formal complaint, follow the complaints procedure on their website. Under data protection rules, they should hold the correct information about you,
          they are stating that you are Mr. Acott.

            Thanks so much i shall do bothof those and then let you no what happens, im not going to be making a offer of payment have never paid anything in 17 years and am not going to reset the clock

              Sorry to bother you again can i send the Sar request by email? And would it be best to do this before i send a complaint about incorrect data?

                  Hi there i have now received the SAR back and it does seem that in 2011 a ccj was given onbthe account, im really in need of some help now as im unsure what to do i don't have the money to pay this the card was initially taken out in 2004 and in 2008 is when link took it over
                  Any help greatly appreciated

                      I think you need to calm down.

                      O.K. they've got a CCJ, because it was in 2011, they would have to go back to Court to act on it. They would need a really good reason for the Judge / Court to entertain the CCJ. I would go ahead and lodge the complaint.

                          They can't 'lie', if they tried, it would have to be a 'whooper', i.e. aliens stole their pens and wouldn't give back when they asked nicely, that sort of thing.

                              No, your complaint is that they hold incorrect records on you. They have referred to you as Mr. Acott. That breaches Data Protection Rules even if it is an error. Tell them you are 'minded' to refer the matter to the ICO.
