  • Old debt

Got a letter from Lowell’s debt collectors today. Said I owed money with Hoist finance . The letter was in my maiden name so the debt is over 20yrs old and has been passed to several debt collectors. I was paying £10 a month for some years but stopped about a year ago. If I ask for the original CCA do you think they could provide after over 20 years?

I can think of one way of finding out for certain.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Litigants in Person should download and read this: https://www.judiciary.uk/wp-content/..._in_Person.pdf

As Atticus says, send the CCA request, make sure you get Proof of Postage.

Keep copies of the method of payment, proof of posting etc. If they can not find the original they will struggle

Received a letter from Lowell’s today saying they will pass onto a third party debt collector and this will mean more letters, emails and sms messages. Although they don’t have my phone number or email address! They also said they will look into my credit history ! What will this actually mean?
I didn’t send a letter asking for the CCA as thought I would leave it a bit longer. They are writing to me every 2 weeks.
Thank you in advance for any help

Probably threaten a 'door step' visit, it really means nothing, 'look into your credit history', it means nothing ,

What do you think you should do? What were you advised to do?

Thank you for your reply . Was advised to ask for CCA but have been a bit scared to start contact with them. They haven’t even got my name correct as using previous married name of over 20yrs ago .
