    I have an employee that is on a zero hours contract. She is employed as a housekeeper and bar maid/receptionist. It has come to my attention that she is clocking in to do house keeping eg last week there was 8 strips, 1 tidy and the bar to clean. She was working with one other member of staff who stripped 7 rooms but this problem employee only cleaned the bar and stripped only 1 room. Both employees clocked up almost 4 hours each yet this problem employee only did an hour and a half’s worth of work. Can I sack her for theft? When she works the bar, it has come to my attention that, if she takes a whim she will call ‘last orders” early and throw people out - on at least one occasion she closed the bar at 10.40 despite the fact we have a 2am license! She clearly has to go so can I also use this as a reason to fire her?

    How long has she been employed?

    Can you not just give her zero hours?

      She’s been with me about a year. Yes I could give her zero hours but she has now gone behind my back and asked other employees to give t
      her some of their shifts. She’s a bloody nightmare!

        If you think that other employees are going to agree to give up there shifts to let her work them, then you may have to consider dismissing her rather than just not giver her any more shifts.

        Since she has been with you less than 2 years then this option is available to you, even if she considers herself o be an employee given the status of her contract
