  • Licence to occupy

Hi everyone can anyone tell me does a licence to occupy, given to a property buyer prior to completion, need to have the consent of both owners of the property in question? Also does the licence have to be drawn up signed off by a solicitor? Many thanks

Such licenses are informal in nature.

They are also very unwise from both sides.
The buyer waives his right to object if any problem comes up on the title, and the seller has no means of recovering possession. The soicitor should advise very strongly against it.

If this is connected to your previous threads, then there is obviously a great deal more behind an apparently simple question.

If not connected, some explanation of the background might assist.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Litigants in Person should download and read the Judiciary's handbook for litigants in person: https://www.judiciary.uk/wp-content/..._in_Person.pdf
